BE IT REMEMBERED, that the White County Commissioners held a regular meeting on Monday, February 3, 2014. The meeting was held at the White County Building, 2nd floor Commissioners’ Conference room beginning at 8:00 a.m.

Commissioners present were: President John C. Heimlich and Member David Diener. Also present was the White County Attorney George Loy, White County Auditor Gayle Rogers and the Commissioner’s Secretary Donya Tirpak.

Commissioner Heimlich called the meeting to order.

MINUTES

Minutes from the last meeting were not presented at this time.

PAYROLL

  • Commissioner Diener made a motion to approve payroll as presented for February 3, 2014, seconded by Commissioner Heimlich. Vote: Unanimous

CLAIMS

  • Commissioner Diener made a motion to approve and pay the claims as presented, seconded by Commissioner Heimlich. Vote: Unanimous

EMA GRANT APPLICATION

EMA Director Dean Mullens presented a 2013 Emergency Management Performance Grants-Projects Sub-grant Agreement from the Indiana Department of Homeland Security (IDHS). The IDHS offers bonus money each year to EMA departments who score above and beyond by submitting reports, planning for disasters and holding training exercises. Last year they received $4,100 and this year they received $5,200.

They would like to use this years money to purchase to purchase surveillance equipment that can be used by the town marshals, Sheriff’s Department and the City of Monticello Police. The sub-grant is for an amount not to exceed $5,179.77.

The grant will be used to purchase the following:

42” Monitor $550.00

55” Monitor $900.00

Flir Systems Infrared Camera $3,149.00

Mobile Monitor Cart $ 525.00

  • Commissioner Diener made a motion to approve the Sub-Grant Agreement CFDA #97.042 as presented, seconded by Commissioner Heimlich. Vote: Unanimous

REQUEST TO REZONE PROPERTY

White County Attorney George Loy presented a resolution that will be submitted to the White County Area Plan Commission requesting them to rezone property located at 911 N. 1200 W., in Wolcott from an I-2 to an I-3. This property is part of the Wolcott Corridor project.

 

RESOLUTION OF THE BOARD OF COMMISSIONERS

OF WHITE COUNTY, INDIANA, FOR REZONING OF

COUNTY-LOCATED PROPERTY

WHEREAS, certain real estate owned by DENNIS A MATHEW (1/2) & ROBERT ARMOND MATHEW REV LIV TR DTD 10-29-12 (1/2), located at 911 N. 1200 W, Wolcott, Indiana; and

WHEREAS, said property is zoned “I-2, Heavy Industry, under the White County Indiana Zoning Control Ordinance which zoning is inappropriate for its planned use; and

WHEREAS, the White County Commissioners desire said property to be rezoned to “I-3”, Industrial Park, in order that the planned use of said property be in conformance with the White County Indiana Zoning Control Ordinance.

NOW, THEREFORE, BE IT HEREBY RESOLVED by the White County Commissioners that the White County Area Plan Commission consider and make recommendation to the rezone of said property, located at 911 N. 1200 W., Wolcott, Indiana (Parcel Identification #:91-76-27-000-001.600-017, Tax ID#:012-81330-00) from “I-2” to “I-3”.

  • Commissioner Diener made a motion to approve Resolution No. 14-02-03-01 to the APC requesting the rezoning of property at 911 N. 1200 W, Wolcott, Indiana, from an I-2 to an I-3 as presented, seconded by Commissioner Heimlich. Vote: Unanimous

TOWN OF WOLCOTT

Mike Yelton, Town of Wolcott Council member, appeared before the commissioners discussing two properties that the town would like to acquire that are currently on the Commissioners’ Tax Sale.

Mr. Yelton presented Resolution No. R2014-01 from the Town of Wolcott requesting the tax sale certificates for property located in Wolcott, Indiana. The resolution was passed at their meeting held on January 28, 2014.

The Town Council of Wolcott would like to obtain the real property located at:

1) 205 East North Street, Wolcott, Indiana, with Key No. 91-75-30-000-005.500-018, formerly owned by Walter Owens, and described as follows: JKD LOT 22 24’ x 120’ VACATE DVIS ST .30 698, 593, along with all buildings, fixture and personal property associated therewith; and

2) 207 North Burke Street, Wolcott, Indiana, with a Key No. 91-75-30-000-019.300-018, formerly owned by Walter Owens, and described as follows: FIRST ADD LOTS 9 & 10 & N ½ LOT 8 698, 593, along with all buildings, fixture and personal property, and

White County Attorney George Loy said that the commissioners can go ahead and approve the transfer of the tax certificates to the Town of Wolcott and he will write up a resolution by the end of the day.

  • Commissioner Diener made a motion to assign Resolution No. 14-02-03-02 for the transfer of tax sale certificates to the Town of Wolcott for property located at 205 East North Street and 207 North Burke Street, Wolcott, Indiana, as requested, seconded by Commissioner Heimlich. Vote: Unanimous

Notification will be given to SRI to remove these two properties from the 2014 Commissioners’ Tax Sale list.

PROPERTY ACQUISITION – WOLCOTT CORRIDOR PROJECT

  • Commissioner Diener made a motion to approve Resolution No. 14-02-03-03 to purchase 21.164 acres from Dennis A. Mathew and Millie S. Mathew and 27.35 acres from Dennis A. Mathew and the Robert Armond Mathew Revocable Living Trust as presented, seconded by Commissioner Heimlich. Vote: Unanimous

Commissioner Diener said that we will have to have two appraisals on the properties to establish a fair market value.

RESOLUTION NO. 14-02-03-03

RESOLUTION OF THE WHITE COUNTY BOARD OF

COMMISSIONERS FOR PURCHASE OF REAL ESTATE

 

WHEREAS, the White County Board of Commissioners is interested in purchasing certain tracts of real estate from Dennis A. Mathew and Millie S. Mathew, husband and wife, consisting of approximately 21.164 acres, and from Dennis A. Mathew and the Robert Armond Mathew Revocable Living Trust, consisting of approximately 27.35 acres, situated in White County, Indiana, and more particularly described on attached Exhibit “A”; and,

WHEREAS, the Board of Commissioners have appointed two (2) appraisers professionally engaged in making appraisers or trained as appraisers and licensed as a broker under I.C. 25-24.1, to appraise the fair market value of said tracts of real estate, and said appraisers have returned their separate appraisals to the Board of Commissioners.

NOW, THEREFORE, BE IT HEREBY RESOLVED that the White County Board of Commissioners be authorized to purchase either or both of said tracts of real estate for no more than the average of the two said appraisals.

ENGINEERING AGREEMENT – WOLCOTT CORRIDOR PROJECT

Commissioner Heimlich presented an Engineering Agreement from American Structurepoint, Inc. The purpose of the agreement is to have American Structurepoint design a potential water main interconnection between the Town of Wolcott and the Town of Remington. The contract is not to exceed $13,000.

  • Commissioner Diener made a motion to enter into a contract with American Structurepoint as presented for $13,000, seconded by Commissioner Heimlich. Vote: Unanimous
