DECEMBER 16, 2013

BE IT REMEMBERED, that the White County Drainage Board held a regular meeting on Monday, December 16, 2013. The meeting was held at the White County Building, 2nd floor, Commissioners’ conference room beginning at 10:30am.

Drainage Board members present were: President Steve Burton, Vice President John Heimlich and Member David Diener. Also, present were White County Attorney George W. Loy, Surveyor Bradley E. Ward and the Surveyor’s Secretary Sharon Broussard.

Others present were:

Robert W. Gross – Robert W. Gross & Associates

B.J. Propes – White County Highway Department

Drainage Board President Steve Burton called the meeting to order.


  • Vice President John Heimlich made a motion to approve the minutes as presented for the regular meeting held on December 2, 2013, seconded by Board Member David Diener. Vote: Unanimous

Magnetation – Right to encroach on S.Holcomb Branch of the Esther Fraser #535

Bob Gross; Robert W. Gross & Associates, present to represent Magnetation. On behalf of Magnetation, Bob Gross, is requesting permission to extend encasement to the east side of the existing drain. Magnetation is putting in a transfer that goes over the county tile. White County Surveyor, Brad Ward, spoke with Magnetation previously and advised that White County would probably go with CSX specs.

Accu-Dig Services, Inc. has cleaned out and video-taped the drain. Drainage Board Vice President John Heimlich asked if the current tile was reinforced, how large the tile is and if the location of the tile was changed. Bob Gross stated the Veri-Sun project extended the drain and encased it in cement and the tile is fourteen inches. White County Surveyor, Brad Ward, stated the location of the tile has not changed.

White County Attorney George Loy requested the Magnetation real estate description for Exhibit A. Bob Gross will provide this information.

  • Board Member Heimlich made a motion to approve Magnetation’s request to encroach on the S.Holcomb Branch of the Esther Fraser #535, seconded by Board Member Diener. Vote: Unanimous


Todd Frauhiger, P.E, AECOM, presented and recommends the drainage plan for approval. The water will be directed around the property into a paved side ditch and discharged along the road underneath the existing fifteen (15) inch pipes. The flows are dropping about 20% from the existing conditions by putting the curve down the side and routing around the property and discharging it in front. There will be a paved ditch running around the property. The plan has the capacity of carrying the fifty (50) year storm. Storm water will drain out along Highway 24 right-of- way and East to Buss Ditch #518.

Board Member Diener stated the ADA requirements for handicapped parking spaces need to be taken into consideration with Area Plan.

  • Board Member Diener made a motion to approve the drainage plan as presented for Gutwein Motor Company, seconded by Board Member Heimlich. Vote: Unanimous

BAHLER HOG FARM – Drainage Plan

Todd Frauhiger, P.E, AECOM, presented the drainage plan. The project exceeds the drainage code, but the proposed eight (8) inch tile goes offsite, over an adjoining landowner, to an existing private tile and then the private tile makes its way to the county drain.

Surveyor Ward advised Jeff Bahler a letter on file from the adjourner is necessary to grant an easement for the tile and using the adjourner’s private tile to get to the drain. The easement has not been received by Surveyor Ward from Bahler Hog Farm.

White County Attorney George Loy does not recommend approval of the drainage plan until the easement is received from the adjourner. At this time the Drainage Board took the recommendation of the County Attorney and did not act on the drainage plan.

C.M. MERTZ BRANCH #2 #562 – Petition for Reconstruction

Herb Whiteman carried the petition. Herb Whiteman and Paul Bridge signed the petition; however they are not on the watershed, nor are they assessed on this tile. They pump their water to the county ditch. What goes thru their property is private. It is not the County tile.

White County Attorney George Loy does not recommend approving the Petition for Reconstruction for the landowners outside the watershed.


White County Surveyor Brad Ward has been in contact with Mr. Tim Clark of Clark Brothers Hog Farm. He will be meeting Mr. Tim Clark at the hog farm to review the 2001 Drainage Plan and discuss correcting the problems.

The White County Surveyor Brad Ward and the White County Drainage Board cordially welcomed the new White County Surveyor’s Secretary Sharon Broussard.

There being no further business to come before the board their meeting was adjourned.
