APC MEETING April 14, 2014

The White County Area Plan Commission met Monday, April 14, 2014, at 6:00 p.m. in the Commissioners’ Meeting Room, Second Floor, County Building, Monticello, Indiana.

Members attending were: Jim Annis, Mark Bentlage, Richard Lynn, Jim Mann, Dennis Sterrett, Dave Stimmel, Brad Ward, and Donald Ward.   Absent members were: Charles Anderson, Dave Rosenbarger and Mike Smolek.

Also attending were Executive Director Joe Rogers, and Building & Planning Dept. Secretary, Tina Cronkhite.  Attorney, Abigail Diener, was absent.

Visitors attending were:  Ed Federer and Justin Alberts.

The meeting was called to order by President, James Mann.

Opening Business:

Minutes: There was a motion by Jim Mann and a second by Denny Sterrett to approve the meeting minutes of 03/10/2014 as written; so moved.

Rezones:

#1016– VanMeter, Travis & Heidi - Request for a rezone from A-1, General Agriculture District to B-2, General Business District.

Owner, Travis VanMeter was in person to request the rezone.  The rezone request was applied for in order to obtain a Dealer License to buy semi-trailers direct from the manufacturer. A Dealer’s License cannot be obtained from the State unless the site is locally zoned for such activity.  There will be no inventory kept at the location.  See Exhibit B - Letter of Intent

In consideration of the White County Area Plan Commission’s favorable recommendation and the White County Commissioners’ approval of the Rezone Petition identified as Petition #1016, Travis W. & Heidi VanMeter make a Written Commitment, pursuant to IC 36-7-4-1015.  See Exhibit A – Written Commitments

There being no additional questions or comments, ballots were passed to board members by Joe Rogers.

Ballot Summary:

1. The proposed rezoning is consistent with the goals, objective, and policies of the White County Strategic Plan and any other applicable planning studies and reports, as adopted and amended from time to time.  8 agree; 0 no opinion; 0 disagree

2. The proposed rezoning is compatible with current conditions and the overall character of existing development in the immediate vicinity of the subject property.  7 agree; 0 no opinion; 1 disagree; Comments: Drainage should be looked in to.

3. The proposed rezoning is the most desirable use for which the land in the subject property is adapted.  6  agree; 2 no opinion; 0 disagree

4. The proposed rezoning will not have an adverse effect on the value of properties throughout the jurisdiction.  8 agree; 0 no opinion; 0 disagree

5. The proposed rezoning reflects responsible standards for growth and development.  7 agree; 1 no opinion; 0 disagree

President, Jim Mann announced the results, as follows: 8 votes cast; 8 in favor - 0 opposed – 0 Abstentions.  Rezone request will be certified to the appropriate legislative body with a “Favorable” recommendation.

#1017– White County, Indiana - Request for a rezone from A-1, General Agriculture District to I-3, Industrial Park District.

Joe Rogers, Area Plan Executive Director, is present to serve as the representative for this rezone.  This location has been identified to be included in the area known as the Mid-America Commerce Park with plans to bring an industrial use to the site consistent with the I-3 development uses and standards of the White County Indiana zoning control Ordinance.  See Exhibit C – Resolution No. 14-04-07-01

Justin Alberts, local land owner, asked general questions about the Mid-America Commerce Park, pointedly toward the potential for construction of buildings and a time frame for completion at the sites under consideration at this meeting.  Joe Rogers welcomed Justin to stop in the Area Plan office to review the plans and photos for the spec building if he is interested.  Mr. Rogers responded by indicating to Mr. Alberts that there are currently no plans for construction at the sites under consideration this evening.  It is expected that after the spec building is occupied, these sites would be the next locations for development.

Written Commitments

This Written Commitment (“Commitment”) is made effective as of the ____ day of _________, 2014 by Travis W. & Heidi VanMeter, as Property Owners.

Recitals

Whereas:  Travis W. & Heidi VanMeter desire to utilized a two (2) acre (+/-) site located in Monon Township, White County, Indiana, in full compliance with the terms and requirements as set forth in the White County Indiana Zoning and Subdivision Control Ordinances as a B-2 zoned property.

Whereas:  Said two (2) acre parcel is currently located in an A-1, General Agriculture zoning district and is identified with the Tax ID #: 010-35160-00 and Parcel ID #: 91-84-20-000-002.300-013.  The property location is more commonly known as 1244 W. State Road 16, Monon, Indiana 47959.

Now Therefore, Travis W. & Heidi VanMeter agree to make certain commitments to the White County Area Plan Commission and White County Commissioners as follows:

Commitments

In consideration of the White County Area Plan Commission’s favorable recommendation and the White County Commissioners’ approval of the Rezone Petition identified as Petition #1016, Travis W. & Heidi VanMeter make the following Written Commitment, pursuant to IC 36-7-4-1015.

Section 1

Travis W. & Heidi VanMeter agree to install a buffer along the eastern property line, less twenty (20) feet of the northern portion of said line which intersects the Road Right-of-Way of State Road 16, in compliance with the B-2 Buffering Standards as stipulated in the current White County Indiana Zoning Control Ordinance prior to the occurrence of any of the following conditions:

a) Storage of any business related inventory or materials; or,

b) Construction of any business related structures; or,

c) Any business related site improvements exceeding one hundred (100) square feet.

Section 2

Travis W. & Heidi VanMeter agree to fully execute this Commitment, record it in the White County Recorder’s Office and provide a copy of the recorded document to the Area Plan Office prior to said rezoning taking effect.  Travis W. & Heidi VanMeter are given sixty (60) days from the date of rezone approval by the White County Commissioners to supply a recorded copy of this document to the Area Plan Staff or the B-2 District, rezone approval shall become void and the property zoning district remain A-1, General Agriculture.
