The White County Area Plan Commission met Monday January 8, 2001, at 7:30 p.m. in the Commissioner’s Meeting Room, Second Floor, County Building, Monticello, Indiana.

 

Members attending were: Jay Clawson, Charles Anderson, Ron Pollock, Don Ward, Gregory Bossaer and Rick Raderstorf. Also attending were Attorney Altman and Director Weaver.

 

Visitors Attending were: Joseph W. Johnson, Charles VanVoorst, Shirley Buell, Cheryl VanVoorst, Norma Dowden, Jim Dowden, Pat & Dave Zesher Seerber, Jessica Van Voorst, Carol Hendress, Eleanor Williams, Bill Williams, Elisabeth Nelson, Charles H. The meeting was called to order by President Charles Anderson and roll call was taken. Don Ward made a motion to dispense with reading and approve the minutes of July 10, August 14, September 11, October 10 and November 13, 2000. Motion was seconded by Jay Clawson and carried unanimously.

#735 Robert L. Kelly, Inc. Requesting to rezone from A-1 to I-2 on 7.626 Acres. The property is located in the Town of Reynolds and in Honey Creek Township, West of 366 E. U.S. Highway 24.

 

President Anderson stated, he has tabled that, so we really can’t talk on that tonight. Thank you for coming in, some of you found out that it was tabled but, I wanted you to stay here so the Board members could see. We really can’t discuss what he wants to do with that until he actually brings it before this Board.

 

Charlie VanVoorst asked, how many times could he table it?

 

President Anderson stated, really right now, indefinitely.

 

Charlie VanVoorst asked, he could do it every time?

 

President Anderson stated, yes.

An audience member asked, and since it’s tabled, none of us have the right to…

 

President Anderson stated, we can’t really discuss what is going down there unless, he is here and it actually comes before the Board.

 

Dave Server asked, has the Board had the E.P.A. check that ground out there for contamination?

 

President Anderson stated, the new ground that he is trying to rezone?

 

Dave Server stated, no, the old ground.

 

President Anderson stated, he is not doing anything with it, so we wouldn’t have any reason to check it.

 

Dave Server stated, I would just like to see how much contamination he is putting in there.

 

President Anderson stated, that would have to go before a different group of people, that is not before us. We’re not here to discuss the property that he is on right now, anyway. We are really not here to discuss anything because, he hasn’t brought it before the Board, he’s tabled it. I wanted all of you that are here for that, you can leave now but, that gives the Board an idea how many people are here and we have an idea what you are here for on that too.

 

Attorney Altman stated, it will be tabled to…

 

President Anderson stated, the next meeting.

 

Attorney Altman asked, that is when, Director Weaver, so that these people know that.

 

Director Weaver stated, February the 12th.

 

An audience member asked, but he can table it again?

 

Attorney Altman stated, yes, he can.

#736 Charles & Cheryl A. VanVoorst; Requesting to rezone from B-2 to R-2 on 0.54 Acres. The property is located in the Town of Reynolds at 207 & 211 German Street. The property is located in the Town of Reynolds at 207 & 211 German Street.

 

President Anderson asked, do we have anyone here representing this request?

 

Charles VanVoorst and Carol VanVoorst were representing this request.

 

President Anderson asked, do we have anyone here in the audience with any questions about this request? Do the Commissioners have any questions about this request?

 

Jay Clawson asked, did you move that big LP tank? Is that gone?

 

Charles VanVoorst stated, no, it will be in the spring.

 

Jay Clawson stated, that’s the only reservation that I have about making that a residential, zoning that for a mobile home.

 

Charles VanVoorst stated, that’s not in this property at all.

 

Jay Clawson stated, I know but, being that close with the federal regulations, if there was ever an explosion or something.

 

Charles VanVoorst stated, that’s going to be moved in the spring, Impact, it was at one time AgMax, has bought property in Wolcott and they are in the process of getting that arranged to move that to Wolcott.

 

President Anderson asked, are there any other questions? I think that we’re ready to vote.

 

With no further discussion the Board voted.

 

The results of the vote were as follows: 6 affirmative and 0 negative. This will be presented to Town Board of Reynolds for their action. 

Attorney Altman stated, we will serve them probably tomorrow so you should check with them to see whether they get it. They usually handle it the next meeting after that. We never know for sure when they will actually be making the final decision on this.

#737 Herbert Hunt; Requesting to rezone from A-1 to R-2 on 0.411 of an acre. The property is located North of Buffalo on Valley Court.

 

President Anderson asked, do we have anyone representing this request?

 

Joseph Johnson was representing this request.

 

President Anderson asked, do we have anyone in the audience with any questions about this request?

 

Herman Arvia stated, we just moved into the area in a cottage and we just want to know what is going on, that’s all.

 

President Anderson asked, do you want to respond to that?

 

Joseph Johnson stated, I just wanted to buy it so I could store my boats and my lifts, that is all that I want to do.

 

President Anderson asked, is there a building on it now?

 

Joseph Johnson stated, no.

 

President Anderson asked, do you want to put a building on it?

 

Joseph Johnson stated, I may later but, I won’t right now.

 

President Anderson asked, do you have any other questions?

 

Carmen Arvia stated, we had heard that it was going to turn into a parking lot.

 

Joseph Johnson stated, parking lot? It’s just for my stuff.

 

Director Weaver asked, you own a lot across from that correct?

 

Joseph Johnson stated, caddy cornered, yes.

 

President Anderson asked, do the Commissioners have any questions about this request?

 

Director Weaver stated, we did have another adjoining property owner come into the office named Orville Shelton. He came in concerned with drainage and he feels that the property could be worse if he used it for parking and had concerns about that.

 

President Anderson asked, are you going to add gravel to that? Are you going to black top it?

 

Joseph Johnson stated, I will probably add gravel to it.

 

President Anderson asked, do you have a water problem out in that area?

 

Joseph Johnson stated, I just bought our place too.

 

President Anderson asked, do you have any problems?

 

Carmen Arvia stated, we don’t know because, we just bought it in July. So we don’t really know.

 

Charlie Mellon asked, is that 3 crossroads North of Buffalo and then East where the old Hunt property is?

 

Joseph Johnson stated, yes, Herbert Hunt.

 

Charlie Mellon stated, I know where that property is and I don’t think that there is any water problem there, it’s on high ground. It’s on the South side of that road.

 

Joseph Johnson stated, yes.

 

President Anderson asked, with gravel you’re going to have some drainage down to the ground. You’re not going to put it in asphalt?

 

Joseph Johnson stated, no, I’m not going to put asphalt.

 

Charlie Mellon stated, that drains right down to the river. It’s not a ½ of a mile from the river.

 

Joseph Johnson stated, no.

 

President Anderson asked, are there any other questions? If not let's go ahead and vote.

 

Attorney Altman stated, from the looks of the plat, it looks like it’s a lot away from the river and you own lot #25. Is that right Mr. Hunt?

 

Herbert Hunt stated, no, I live at 96 something Valley Court.

 

Jay Clawson asked, which lot number in Valley Court do you own?

 

Herbert Hunt stated, 9624.

 

Attorney Altman asked, so yours would be right next to his?

 

Herbert Hunt stated, one away, there’s his house a lot and then ours.

 

Jay Clawson asked, do you live in this lot?

 

Herbert Hunt stated, yes.

 

Attorney Altman asked, his lot would be which one, Jay?

 

Jay Clawson stated, lot #24.

 

Attorney Altman stated, so if there is a drainage problem, we would require that and he would inspect that.

 

Joseph Johnson stated, yes.

 

Attorney Altman stated, I just wanted to put that on the record that there was a water problem and it’s near the river so surely you can get rid of the water if that’s the problem.

 

Herbert Hunt stated, there’s a drainpipe that goes out there, I don’t know where it’s coming from but it stops in the middle of the yard.

 

President Anderson stated, it’s probably someone else’s drainage coming in there.

 

Herbert Hunt stated, probably.

 

Herman Arvia asked, does the ground slope back towards the farm field behind that property that you just bought?

 

Joseph Johnson stated, I don’t know.

 

With no further discussion the Board voted.

 

The results of the vote were as follows: 6 affirmative and 0 negative. This will be presented to County Commissioners for their action. 

Attorney Altman stated, they have the final decision on that. It will be right here Monday morning about 8:30 a.m.

 

Joseph Johnson asked, do I have to be here?

 

Attorney Altman stated, if it was my property I would be here.

#738 Michael L. & Dianne L. Williams; Requesting to rezone from B-2 to I-1 on 15.309 Acres. The property is located in Monon Township on the West side of C.R. 150 E., just South of Monon Road. 

President Anderson asked, do we have anyone representing this request?

 

Troy Paluchniak was representing this request.

 

President Anderson asked, do we have anyone here with any questions about this request?

 

Director Weaver stated, I would like to tell the Board what is going on here. There are 2 existing businesses on this property. They are in the process of building a new building for one of those businesses and they had rezoned this property in 1992. At that time, it was in accordance with existing ordinance but, when we adopted this new ordinance it took them out of compliance again. So they are trying to bring in compliance what they already have on the property so they can build this new building. 

 

President Anderson asked, do the Commissioners have any questions about this request? If not I say let's go ahead and vote.

 

The results of the vote were as follows: 6 affirmative and 0 negative. This will be presented to County Commissioners for their action. 

Attorney Altman stated, right here at 8:30 next Monday morning.

#250 Nathan D. Virkler; Requesting secondary approval of a 2 lot subdivision to be known as Kingdom Subdivision on 0.33 of an Acre. The property is located in the Town of Wolcott on the Northwest corner of Range Street and Blake Street.

 

President Anderson asked, do we have anyone representing this request?

 

Joel Virkler was representing the request.

 

Attorney Altman asked, do you have some papers for us?

 

Joel Virkler stated, yes, this is the plan.

 

Director Weaver stated, that is a letter that I sent for corrections of the plat. There is a copy of that in the file.

 

Attorney Altman stated, so the Board knows what you have. We have the request and the plat.

 

Director Weaver stated, we have a copy of that as well in the file.

 

Attorney Altman asked, does the Board have a copy of this?

 

Director Weaver stated, they did at one time.

 

Jay Clawson asked, Director Weaver, do we need to put this in the record?

 

Director Weaver stated, I was just going to mention that, we have a letter, Exhibit A, that we received today from the Town of Wolcott regarding water and sewage to the property and they say that there is no problem getting that to these properties. The original is in the file.

 

Jay Clawson stated, I like to see that, that the Town Board does not have a problem because we got talking about subdividing a property, in a Town, that is already laid out as a lot. It’s a kind of practice that we don’t like to see but, on that street, it’s a special kind of situation. I wouldn’t like to see a precedence of that becoming, splitting out the city lots all of the way through these towns. I don’t think that it would end up being too high density housing but, if we can get the Town Boards to say that they are in favor of it that means a lot to me.

 

Attorney Altman stated, for the record we have the Town of Wolcott giving us the assurance that there will be drainage and water. We also have the amendment that the change of the Ordinance. Director Weaver indicates that the standards of the Subdivision Ordinance have been completely met at this time, with the assurances and modifications.

 

The Secondary Approval request for a subdivision to be known as Kingdom Subdivision located in the Town of Wolcott, was approved by a vote of 6 to 0, based on a finding of fact that the Standards of the Subdivision Control Ordinance have been met, primary approval has been granted and the Subdivision is in compliance. 

Attorney Altman stated, your subdivision is approved. We have a 10 day waiting period.

 

Director Weaver stated, you need to have your dad come in and sign the plat when it is convenient, in my office.

#254 Michael Brown; Requesting approval of a 2 lot subdivision to be known as Brown Acres Subdivision on 2.35 Acres. The property is located in Monon Township at 4520 W. 850 N. 

President Anderson stated, we don’t have anyone representing this request so we will table it.

 

Attorney Altman stated, I think that you should write a letter to him telling him that it would be dismissed and have someone come here next meeting.

 

Director Weaver stated, this is his first, we didn’t have a meeting last month.

 

Don Ward stated, that stuff wasn’t tabled.

President Anderson stated, next on the agenda would be reorganization as far as business. We need a President and a Vice President.

 

Attorney Altman conducted the election of officers. Greg Bossaer motioned that Charles Anderson remain as President with Jay Clawson seconding the motion. President Charles Anderson continued conducting the election of officers. Don Ward motioned Jay Clawson as Vice-President with Greg Bossaer seconding the motion. Don Ward motion himself as Secretary with Jay Clawson seconding the motion. Don Ward motioned that Jerry Altman remain attorney with Jay Clawson seconding the motion. All Voting was unanimous.

 

Attorney Altman stated, we need to select someone this evening to sit on the Board of Zoning Appeals. Ron Pollock, would you be interested?

 

Ron Pollock asked, for how long?

 

Attorney Altman stated, 1 year.

 

Ron Pollock asked, does that mean that I have to attend both meetings?

 

Director Weaver stated, it’s actually to finish out a 4-year term, it’s 2 years. It expires December 31, 2002.

 

Attorney Altman stated, you would have to attend the meetings.

 

Director Weaver stated, you’re a voting member.

 

President Anderson stated, do we have a nomination for a member for the Board of Zoning Appeals?

 

Jay Clawson made a motion.

 

Don Ward seconded the motion.
