BE IT REMEMBERED, that the White County Drainage Board held a regular meeting on Tuesday, February 17, 2015. The meeting was held at the White County Building, 2nd floor, Commissioners’ conference room beginning at 10:30 a.m.

Drainage Board members present were: President Steve Burton, Vice President John Heimlich and Member David Diener. Also, present were the White County Attorney George W. Loy, White County Surveyor Bradley E. Ward and the Surveyor’s Secretary Sharon Broussard.

Others present were:

Mike Kyburz - White County Highway Dept.

J.D. Smith - White County Highway Dept.

Sharon Watson – White County Soil & Water

President Burton called the meeting to order.


  • Vice President Heimlich made a motion to approve the minutes as presented for the regular meeting held on February 2, 2015; seconded by Member Diener. Vote: Unanimous


Surveyor Ward requested the White County Drainage Board requirements from NIPSCO for the company or subcontractors to install power lines near county regulated ditches. The Surveyor wants to ensure the landowners are legally protected if anything should happen during installation of power lines. He presented a chart of open ditches and tiles to the Drainage Board to review. The chart lists the drains within 200 feet of the easement or intersecting power line. The installation is predicted to start the beginning of 2016.

President Burton asked the Surveyor if NIPSCO will be purchasing or leasing the land. Vice President Heimlich and Surveyor Ward responded to the question and replied “leasing”.

NIPSCO subcontractor corresponding with Surveyor Ward asked if NIPSCO would be able to reroute a tile if that is where the tower should be installed. Burns & McDonnell, Kansas City, Missouri, is the environmental studies & permitting agent requesting the information for NIPSCO.

White County Highway Superintendent Mike Kyburz commented they require a $50,000 bond for 5 years.

White County Attorney Loy made the recommendation to meet with Surveyor Ward and NIPSCO representatives to discuss their expectations and responsibilities.

The Drainage Board directed Surveyor Ward and Attorney Loy to meet with NIPSCO’s representative. The Board agrees that a bond or separate bonds should be required.

There being no further business to come before the board, their meeting was adjourned.
