BE IT REMEMBERED, that the White County Drainage Board held a regular meeting on Monday, May 4, 2015. The meeting was held at the White County Building, 2nd floor, Commissioners’ conference room beginning at 10:30 a.m.



Drainage Board members present were: President Steve Burton, Vice President John Heimlich and Member David Diener. Also, present were the White County Attorney George W. Loy, White County Surveyor Bradley E. Ward and the Surveyor’s Secretary Sharon Broussard.

President Burton called the meeting to order.



MINUTES

  • Vice President Heimlich made a motion to approve the minutes as presented for the regular meeting held on April 20, 2015; seconded by Member Diener. Vote: Unanimous



HERRON-DILTS #544 – PETITION FOR MAINTENANCE

The petition carried by Ryan Layer, tenant. The maintenance fund has $559.54. Currently collects $3.00 an acre and $5.00 minimum. The annual assessment is $1,879.04. The four year maximum is $7,516.16 and is on the 2015 Assessment report. There are approximately 319.000 acres in the watershed. White County requested Cass County to collect on this ditch in 2015.

Surveyor Ward distributed landowner information to the White County Drainage Board. White County will send Cass County a request to waive their rights for a Joint Board.

  • Vice President Heimlich made a motion to accept the Petition for Maintenance on the Herron-Dilts #544; seconded by Member Diener. Vote: Unanimous







CROWELL-WELLS #721 – APPOINTMENTS

Surveyor Ward read from the local government laws.

Indiana Code No. 36-9-27-14

Proceedings affecting more than one county; joint boards

(1) If land in two (2) counties may be affected, the chairman of the board of each county shall appoint two (2) of the members of his board, other than the county surveyor, to serve on the joint board. In addition, a fifth member shall be appointed by the four (4) members of the joint board. The fifth member must reside in a county that is not affected by the drainage problem.

The surveyor has contacted the Cass County Surveyor, Jenny Clark, regarding the fifth member for the Joint Drainage Board. Carroll County will have two members. Member Diener was appointed to the Joint Drainage Board on April 20, 2015.

  • Vice President Heimlich made a motion to appoint President Burton to the Crowell-Wells #721 Joint Board with Carroll County; seconded by Member Diener. Vote: Unanimous





FRONTIER HIGH SCHOOL – DRAINAGE WAIVER REQUEST

Surveyor Ward explained the sports complex area and addition (3,500 square feet) on the north side of the Frontier High School to the Drainage Board. The sports complex is a softball/baseball field that will have a concession stand/press box structure added to the area. The school itself does not have a drainage plan. They have a retention pond for the school; however it predates the drainage plan requirements. President Burton said since they do not have a plan that they need a waiver, otherwise they would have to get a plan.

The Drainage Board granted the waiver request by the time Mr. Roger Malone, Gibraltar Design, arrived at the meeting.

  • Vice President Heimlich made a motion to grant a waiver from the White County Drainage Ordinance to Frontier High School for the projects; seconded by Member Diener. Vote: Unanimous













CHARLES SHIGLEY #582 – MAINTENANCE MODIFICATION – SET RATES

The maintenance fund has $(-4,597.76). Currently collects $0.50 an acre and $5.00 minimum. The annual assessment is $841.94. The four year maximum is $3,353.16 and is on the 2015 Assessment report. There are approximately 1,647.28 acres in the watershed. The Town of Chalmers pays on 132 acres of this watershed.

Surveyor Ward explained there is a large amount of water going thru this very old clay tile. This tile drains the south side of Chalmers and runs along 700S to the Ella Baker ditch. Work orders have been sent out the last two years.

He proposed collecting $2.00 an acre until it has to be increased again. The landowners will have to receive letters with a proposed rate change from White County.

President Burton request confirmation there has not been a previous rate increase.

  • Vice President Heimlich made a motion to set the rate for advertisement at $2.00 on the Charles Shigley #582; seconded by Member Diener. Vote: Unanimous





DITTMAN-LODS #677-PETITION FOR MAINTENANCE

The petition was carried by Mike Schroeder. The maintenance fund has $8,517.72. Currently has variable rates and $5.00 minimum. The annual assessment is $2,211.60. The four year maximum is $11,478.36 and is on the 2015 Assessment report. There are approximately 2,495.122 acres in the watershed. White County requested Carroll County to collect on this ditch in 2015.

Rick Roach and John Peters, landowners, are in Carroll County.

  • Vice President Heimlich moved to accept the Petition for Maintenance on the Dittman-Lods #677; seconded by Member Diener. Vote: Unanimous











Additional Comments

ESTHER FRASER #535

Vice President Heimlich requested an update on the Esther Fraser #535 ditch. Surveyor Ward said there was a Reconstruction Project in 2007. There is currently an issue with silt and water not getting away. The surveyor’s department will inspect and



get the grades for this area.
