The White County Area Board of Zoning Appeals met Thursday, June 16, 2016, at 6:00 p.m. in the Commissioners’ Meeting Room, Second Floor, County Building, Monticello, Indiana.

Present: Randy Conwell, Carl Hites, Dave Rosenbarger, Dennis Sterrett

Absent: Richard Holmes

Also attending were Attorney Abigail Diener, Executive Director Joe Rogers, and Board Secretary, Annette Cobb.

Visitors attending were: Mark and Jackie Dobbins

The meeting was called to order by Chairman Hites at 6:00 p.m.



Appoint new board secretary: Executive Director Rogers recommended Annette Cobb as board secretary, Dave Rosenbarger made the motion to accept, and Dennis Sterrett seconded. The motion was carried unanimously.


There was a motion by Dave Rosenbarger and a second by Dennis Sterrett to approve the meeting minutes and findings of fact of April 21, 2016 as written. Motion was carried unanimously.

Note: At the introduction of each case hearing, Director Rogers introduced the Staff Report and affiliated documents into the official record of the meeting, to be used as supporting documents for developing the Findings of Fact for each hearing.

Variances & Special Exceptions

Variance Petition #2937-Special Exception Use-Hunt & Company LLC (cont’d from 4/21/16)

Executive Director, Joe Rogers, explained the status of continued special exception variance #2937. The applicant’s father, who is also the owner of the neighboring property, contacted the office and advised that he was not going to be willing to provide any land to accommodate the proposed gun range. The office has not heard anything further from Mr. Hunt. Options were explained to the board. The Board directed Executive Director Rogers to contact the applicant to affirm his intentions. It was motioned to continue the variance to the next meeting by Dennis Sterrett and seconded by Dave Rosenbarger. Motion to continue the request was carried unanimously.

Variance Petition # 2938-North White Jr. & Sr. High-Vandaco Signs

North White was going to request a variance for a sign size that was subsequently modified resulting in the elimination of the need for a variance. The applicants withdrew their petition.

Variance Petition # 2939-Gregory & Cynthia Pownell

Variance #2939 was for a new residence. The property owners, after consulting with the neighbors, determined that the neighbors were not going to be happy with what the property owners were asking for, so the applicants have withdrawn their request and will try to redesign their house to accommodate their neighbors’ concerns.

Variance Petition # 2940-Mark & Jackie Dobbins

Director Rogers addressed the board and explained that the board received a petition from the applicant expressing the neighbors support for the request. This petition was not audited by the Area Plan office or the auditor’s office; thus, the names and addresses have not been verified or confirmed. The Board will need to weigh consideration of the petition based on its face value. There was one phone call on May 26th questioning the height of the deck and if there would be any perimeter features. The deck is to be 29-30” at the foundation and 36-38” at the perimeter and that they will install a railing/gate at 40-42” tall. Applicant is requesting a 23.4’ front setback (30’ required) off of Kozy Kove Dr., and a 2.5’ side setback from the east property line (6’ required). Chairman Hites informed the applicant’s that since one of the board members were absent that the applicant had the option of continuing the hearing until there was a full board available. Mark Dobbins indicated that he would like to proceed with the hearing. Chairman Hites explained to the applicant’s that since they were requesting two variances they could have their variances considered individually on separate ballots, or considered as a single request on one ballot. Mark & Jackie Dobbins requested that the variance be voted on jointly under a single ballot. Director Rogers read the staff report and presented pictures of the site. Mark Dobbins addressed the board. He explained that they are putting the steps off the west side of the deck so the steps would not encroach any closer to Kozy Kove Road than is absolutely necessary. Board member Board Member Mr. Conwell asked Mark how close the electrical pole is to his proposed deck. He informed the board that the pole is 13 ft off to the side of the deck. Mark was also asked where the sewage pump and well are located. Mark stated that the sewage pump is located on the Stahl Road side of the property. The well is located on the neighbor’s property. Mark and Jackie would like to build the proposed deck for quality outdoor living space. When there were no further questions from the applicant, or board, Attorney Abigail Diener issued the ballot for voting.

After tabulating the ballots, Chairman Carl Hites read the following results into the record:

Variance Petition # 2940- 4 votes cast; 4 to grant; 0 to deny; Petition #2940 is GRANTED.

There being no further business, Dave Rosenbarger made a motion to adjourn the meeting with a second from Denny Sterrett. Motion carried unanimously. Meeting adjourned.
