BE IT REMEMBERED, that the White County Drainage Board held a regular meeting on Tuesday, September 19, 2016. The meeting was held at the White County Building, 2nd floor, Commissioners’ conference room beginning at 10:30 a.m.

Drainage Board members present were: President Steve Burton, Vice President John Heimlich and Member David Diener. Also, present were the White County Attorney George W. Loy, White County Surveyor Brad Ward and the Drainage Board Secretary Jennifer Hill.

Others present were:

Mike Kyburz – White County Highway Superintendent

J.D. Smith – White County Highway Dept.

Sharon Watson-White County Soil & Water Dept.

President Burton called the meeting to order.



  • Vice President Heimlich made a motion to approve the minutes as presented for the regular meeting held on September 6, 2016; seconded by Member Diener. Vote: Unanimous (3-Favor 0-Opposed)



Surveyor Ward presented the information and aerial photos of the property in question to the Drainage Board for their decision. Michael Streitmatter of Streitmatter Farms proposing to put in a 20,000 sq. ft. cattle barn. This parcel is approximately a 320 acre parcel. He owns ground on the west side of the ditch as well, which is a different parcel. The water eventually drains into the F. Brown Ditch #682. Instead of providing storage here, we had the thought of benefitting the ditch by putting a 40 foot grass strip along the ditch. Robert Gross with R.W. Gross & Associates spoke on behalf of the Streitmatter Farms and provided information on the property and answered questions from the Board.


When there were no further questions from the Board there was a motion by Vice President Heimlich to grant a waiver of the White County Drainage Ordinance; with a second from Member Diener.

Vote: Unanimous (3-Favor, 0-Against.)


Surveyor Ward explained that this item was tabled, he explained that he had received a call earlier this week from Dirk Fleck regarding this petition. During the phone call Mr. Fleck request to go ahead and pull the petition it’s currently working and he doesn’t want to upset neighbors.



Surveyor Ward explained that he and Mr. Burton they held a meeting held with Mike Ezra (County Line Tiling/Excavating) who had the low quote on this project regarding to concerns that property owners had with his prior work. Mr. Ezra did state he would be willing to drop out of the bid if landowners felt that they didn’t want him to do the work. Attorney Loy request if there was an indication that he misunderstood the work to be done on this quote and if he was ready, willing and able to do the work. Surveyor Ward explained that there wasn’t a misunderstanding and that he was able to do the work. The biggest concern is the amount of rocks being left, or put on a ledge and it was going to be County Line’s intention to do similar on this project. Member Diener wanted to know if he seemed willing to withdrawal his bid in order to maintain his positive relationship with the county. Surveyor Ward explained that Mr. Ezra stated that “he (Mike Ezra) didn’t feel like he would be able to meet landowners’ expectations.” Attorney Loy stated that it sounds like he is authorizing the withdrawal of his quote. The next lowest quote is L R Excavating. There was then short discussion as to the specifications of this job and if the contractors are aware of the background of this project and the expectations of the job. After short discussion it was decided to regroup, rewrite specifications of the job of how the rocks will be taken care of and then rebid the project.

When there were no other questions from the Board there was a motion and second by Vice President John Heimlich to requote the W.F. Myers #565 contract and communicate to the contractors the issues involved in the ditch.

Vote: Unanimous (2-Favor, 0-Against); as a land owner in the watershed Steve Burton recused himself from this vote.


Surveyor Ward wanted to let the Board know that there is an Indian Creek Drainage Board meeting September 21, 2016.


White County Highway Superintendent Mike Kyburz wanted to update in reference to the Airport. He explained that the landowner he’s been speaking with is on the airport board and he’s going to push the board to fire their consulting firm and find another. Superintendent Kyburz explained if County Highway is going to be responsible for this he’s thinking about tiling from the outlet down the hill and to the outlet of the bay. With the roadside ditch, we could clean it up and reshape it as needed. It was decided that Superintendent Kyburz and Surveyor Ward would meet and try and come up with a plan.


There being no further business to come before the board, the meeting was adjourned.
