APC SPECIAL MEETING – March 28, 2017

 

The White County Area Plan Commission met Tuesday, March 28, 2017, at 6:00 p.m. in the Commissioners’ Meeting Room, Second Floor, White County Building, Monticello, Indiana.

 

Board Members Present: Charles Anderson, Richard Lynn, Doug Pepple, Dave Rosenbarger, Dave

Stimmel, Dennis Sterrett, Mike Smolek, and Abbey Gross. Additional staff present were: Colin Betts

(Director), Abigail Diener (Attorney), and Tina M. Tiede (APC Secretary). Absent Board Members: Jim

Annis & Brad Ward.

 

Registered visitors were: Cameron Harmon, Randy Mitchell, Art Dragoo, and Phil Gutwein.

 

The meeting was called to order by Charlie Anderson.

Business: #336 - Hutton Subdivision - Hutton Team, LLC; c/o: Cameron Harmon - Parcel ID: #91-73-32-000-000.901-021; Tax ID: #021-18300-01; 1.23 acres out of TRACT OUT SE 32-27-03; 12.21; 518; in Union Township, White County, Indiana, also known as 1091 W Broadway St., Monticello, IN 47960.

 

The owners wish to subdivide the 11.73 acre parcel into 2 commercial lots. The proposed use for the new Lot #1 is to develop an auto parts retail establishment.

 

A Tech Review meeting was held on 2/22/17 at the White County Courthouse (see Tech Review Meeting Minutes dated 2/22/17, attached). The applicant was asked to submit a boundary survey, subdivision name, and building setbacks, which was done in a timely manner. Access is proposed via two easements, one from either side of lot #1. New roads, sidewalks, street lights, water and sewer lines are not proposed nor are needed. All questions regarding impacts to traffic, utilities, and drainage were answered; no negative impacts or degradation of level of service is anticipated. All issues have been addressed to the satisfaction of the staff and all requirements have been met.

 

Cameron Harmon, representing Hutton Team LLC, was in person to represent the request for the subdivision. With no additional questions, Abigail Diener passed out the ballots.

 

President, Charles Anderson announced the results, as follows: 8 votes cast; 8 in favor - 0 opposed – 0 Abstentions. See attached Finding of Fact: Major Subdivision #336; Hutton Subdivision Preliminary Plat.

 

A Tech Review meeting for the Secondary Plat is scheduled for April 13, 2017 at 2:00 p.m. in the Council Room and the Special APC Meeting for the final Secondary Plat approval is scheduled for April 26, 2017 at 6:00 p.m.

There being no further business, Dave Rosenbarger made a motion to adjourn the meeting at 6:03 p.m., with a second from Dave Stimmel. President Anderson called the meeting adjourned.

Dear Cameron;

 

On Wednesday, February 22, 2017, the Area Plan Technical Review Committee reviewed the plans for the proposed subdivision to be located at 1091 Broadway St in Monticello, Indiana. The following is a summary of that meeting.

 

In attendance:

Tech Committee Members: D. Sterrett, D. Ward, D. Pepple, B. Ward, C. Betts

Surveyor/Agent: C. Harmon

General: J. Rogers

 

The meeting was opened by Director Betts with an explanation that subdivision for any non-residential land must follow procedures for a major subdivision in accordance with the Subdivision Control Ordinance. All in attendance were informed that a copy of the minutes would be available in a day. Once all documentation is modified to incorporate the recommendations of the Tech Review Committee, the documents should be brought to the Area Plan Office for scheduling of Plat review with the Area Plan Commission. The deadline for filing is March 2, 2017

 

Discussion items:

  • The submitted Alta survey does not qualify as a “boundary survey”, which should include a depiction and description of the boundaries of the entire parent property.

Surveyor will resubmit survey with boundaries of parent property included.

  • Preliminary Plat must a have subdivision name.

“Hutton subdivision” submitted.

  • One setback line is drawn; building setbacks are not designated for primary/accessory structures.

Answered; setbacks shown on Alta survey and development plans show setback lines for primary structure. Setback table included.

  • Subdivided lot is named “Lot 1”, but the parent lot is not named?

New survey will include named lots. Owner will probably have to obtain a new mortgage anyway – not an issue for Tech Review.

  • Contour lines are partially shown.

  • No watershed map.

Not required.

  • Land stabilization?

Not necessary for preliminary plat; drainage will be addressed in development plans.

  • No covenants or restrictions (statement on plat)?

None.

  • Landowners’ certification/approval for proposed easements.

Answered; not necessary at this time because both lots will remain under the same owner until after subdivided and then sold. Proposed easements will be incorporated in deed sale/transfer later in recorded reciprocal agreements.

  • Drawing should include ROW for U.S. 24; verify ROW – does property line not go to road centerline?

Answered; property line does not go to road centerline.

  • Why does the proposed sanitary sewer easement stop at the proposed property boundary?

Answered; easement is only necessary to the proposed property line.

  • Is there a Drainage Board approval or waiver?

Answered; Drainage Board approval/waiver in hand.

  • Waivers for any requirements?

Answered; No waivers, but development waivers may be requested for final plat.

  • What is the plan for improvements for proposed Easement “B”

Answered; not necessary at this time until after land is split.

  • Is 50’ easement width correct?

Answered; yes.

  • What are the expected traffic impacts? Will proposal degrade established intersection LOS. What is the consideration for 9TH St to continue South?

Answered; No degradation of LOS is anticipated.

  • Sidewalks?

Answered; no – not necessary

PRESENT USE:

The current 11.73 acre tract is currently zoned B-2, General Business District. It is presently used as a commercial retail establishment for the Dye Lumber store.

SURROUNDING LAND USE & ZONING:

The land surrounding this parcel is B-2, General Business District on the East and West sides, and A-1, General Agriculture District to the South.

HISTORY:

The parcel rezoned from A-1 District (General Agriculture) to B-2 District (General Business) for the proposed Kenny Implement Tractor Supply retail establishment.

ANALYSIS:

The nature of the zoning requires that this action proceed through the major subdivision process. A Tech Review meeting was held on 2/22/17 at the White County Courthouse (see minutes dated 2/22/17). The applicant was asked to submit a boundary survey, subdivision name, and building setbacks, which was done in a timely manner. Access is proposed via two easements, one from either side of lot #1. The Area Plan Commission (hereinafter referred to as “Board”) of White County, Indiana, at a public meeting, properly advertised pursuant to IC 5-3-1-2 and IC 5-3-1-4, having heard testimony and reviewed evidence related to the following request(s), does now enter the following

Findings of Fact:

 

  1. The property is located in a B-2 General Business District;

  2. A major subdivision is provided for by Chapters 3 and 5 of the White County Indiana Subdivision Control Ordinance;

  3. A major subdivision is a permitted use for a B-2 District;

  4. The proposal calls for two lots, Lot #1 and Lot #2, with Lot 1 proposed for auto parts retail; Lot 2 is currently used for home improvement retail;

  5. Legal Description: A part of the Southeast Quarter of Section Thirty-Two, Township Twenty-Seven North, Range Three West in the City of Monticello, White County, Indiana (see file for boundary survey with full legal, Recorder’s instrument# 080100123);

  6. The property lies in along U.S. Highway 24, in between two other commercial properties and general agriculture use to the immediate South;

  7. The current use of the parcel is for a home improvement store with excess acreage;

  8. The applicant provided a sketch plat for the area plan commission in accordance with the White county Indiana Subdivision control Ordinance;

 

  1. The applicant provided an initial plat for Tech Review which included proposed lot boundaries, lot sizes, proposed easements, minimum setback standards and other pertinent subdivision standards (see file for plat);

 

  1. Executive Director Betts summarized for the record the minutes from the February 22, 2017 Tech Review Committee meeting (refer to file for minutes).

 

  1. The Staff believes all changes requested by the Tech Review Committee were incorporated into the plat.

  2. Proper notice of the subdivision request was given by mail to adjoining property owners;

  3. The subdivision request was advertised in the paper as required by IC 5-3-1-2 and IC 5-3-1-4;

  4. Staff received communication from the community which asked for clarification of the location of the request; no objections to the request were voiced (see file for Citizen Feedback Log);

  5. Parties in attendance at the hearing included Art Dragoo (property owner) Monticello Dealership Property LLC (neighboring property owner), and Cameron Harmon (applicant);

  6. Mr. Harmon represented the request and offered to answer any questions the Board members might have; there were none;

  7. President Anderson opened the floor to the public; there being no other parties indicating a desire to speak, APC attorney Abigail Diener passed out ballots to the Board members for voting.



Ordinance Consideration Criteria

The Board determined that the Standards of the White County Indiana Subdivision Control Ordinance have been met.



For that reason, the Board gave PRIMARY APPROVAL of the request for a new subdivision to be identified as Hutton Subdivision, and it was so ordered, March 28, 2017.
