APC SPECIAL MEETING – April 26, 2017

 

The White County Area Plan Commission met Tuesday, April 26, 2017, at 6:00 p.m. in the Commissioners’ Meeting Room, Second Floor, White County Building, Monticello, Indiana.

 

Board Members Present: Charles Anderson, Jim Annis, Abbey Gross, Richard Lynn, Doug Pepple, , Dave Stimmel, Dennis Sterrett, and Brad Ward.  Additional staff present: Colin Betts (Director), Abigail Diener (Attorney), and Tina M. Tiede (APC Secretary).  Absent Board Members: Dave Rosenbarger & Mike Smolek.

 

Registered visitors were: Randy Mitchell and Art Dragoo.

 

The meeting was called to order by Charlie Anderson.

Approval Of The Minutes:  There was a motion by Dave Stimmel and a second by Denny Sterrett to approve the meeting minutes of 03/28/17 Special APC Meeting.  Approved unanimously, so moved.

 

Business: #336 - Hutton Subdivision - Hutton Team, LLC; c/o: Cameron Harmon - Parcel ID: #91-73-32-000-000.901-021; Tax ID: #021-18300-01; 1.23 acres out of  TRACT OUT SE 32-27-03; 12.21; 518; in Union Township, White County, Indiana, also known as 1091 W Broadway St., Monticello, IN  47960.

 

The owners wish to subdivide the 11.73 acre parcel into 2 commercial lots.  The proposed use for the new Lot #1 is to develop an auto parts retail establishment.  Access is proposed via two easements, one from either side of lot #1.  New roads, sidewalks, street lights, water and sewer lines are not proposed nor are needed.  All questions regarding impacts to traffic, utilities, and drainage were answered; no negative impacts or degradation of level of service is anticipated.  All issues have been addressed to the satisfaction of the staff.

 

A Tech Review meeting was held on 4/13/17 at the White County Courthouse (see Tech Review Meeting Minutes dated 4/13/17, attached).

 

John Stephens, R.L.S., Inc., was in person to represent the request for the subdivision.  Colin Betts, Executive Director read the staff report into record (see perm. file).  A Request for Waiver was submitted to the Area Plan Commission requesting a waiver from requirements A. 5, A. 9, C, D, & E in Section 3.2.2, and A. 16, A. 18, B, in Section 3.3.2, and Section 3.5 of the White County Subdivision Control Ordinance for the Final plat of Hutton Subdivision to Monticello. The plat has no development detailed upon it and is only for the purpose of creating a new tax parcel. Any development plans for the parcel created by this plat, in the future, would require separate Area Plan Commission approval.

 

With no additional questions, Abigail Diener passed out the waiver ballots. President, Charles Anderson announced the results, as follows:  8 votes cast; 8 to approve – 0 approved with conditions - 0 disapprove – 0 Abstentions.

 

All documentation has been modified to incorporate the recommendations of the Tech Review Committee.

 

With no additional questions, Abigail Diener passed out the secondary ballots.

 

President, Charles Anderson announced the results, as follows:  8 votes cast; 8 in favor - 0 opposed – 0 Abstentions.   See attached Finding of Fact: Major Subdivision #336; Hutton Subdivision Secondary Plat.

There being no further business, Abbey Gross made a motion to adjourn the meeting at 6:11 p.m., with a second from Doug Pepple.  President Anderson called the meeting adjourned.

Dear Cameron;

 

On April 13, 2017, the Area Plan Technical Review Committee reviewed the plans for the Final Plat of the Hutton Subdivision to be located n1091 Broadway St in Monticello, Indiana.  The following is a summary of that meeting.

 

In attendance:

Tech Committee Members:  D. Sterrett, B. Ward, D. Pepple, C. Betts, G. Logan

General: A. Dragoo

 

The meeting was opened by Director Betts with an explanation that the meeting was to review the final plat for the Hutton subdivision.  Normally, secondary plat application and approval occurs after the proposed subdivision has been built, lots sold (if applicable), and major development is complete.  The Hutton Subdivision is a special case wherein no new infrastructure is proposed or warranted, and final plat must occur before deed transactions occur.  There were no significant changes from the Primary Plat approved by the Area Plan Commission.  Once all documentation is modified to incorporate the recommendations of the Tech Review Committee, the documents should be brought to the Area Plan Office for scheduling of Final Plat Approval with the Area Plan Commission.

 

Discussion items:

As-built plans are required for recording a final subdivision plat, including full construction plans for streets, sidewalks, drainage, and parking and loading.

Final Plat includes existing structures (Dye Lumber).  New construction will not proceed until after plat is recorded.

Major subdivisions require an Estimate of Cost for Improvements or surety bond to ensure that new infrastructure is completed.

No new infrastructure is proposed; both items must be waived by the Area Plan Commission.

Building construction plans have been submitted to the Area Plan office for review.

Plans are under review by the Building and Planning Department.

Landscape plans have been submitted to the Area Plan office as part of the construction and development plans.

Plans are under review by the Building and Planning Department.

Land stabilization is addressed in development plans.

Mr. Ward pointed out that the property drains to stormwater infrastructure along U.S. 24.

Dedication or reservation of property to the public.

Applicant is not required to dedicate or reserve property to the public in B-2 zoning district.

Documented landowners’ certification/approval for proposed easements.

Proposed easements will be incorporated in deed sale/transfer later in recorded reciprocal agreements.

Mr. Pepple asked if existing entrance/egress was adequate to the proposed use.  Chief Logan asked if U.S. 24 would need to be widened for additional traffic.

Answered; existing entrance/egress is adequate; INDOT expressed no issues with traffic or right-of-way.                         No impact study or traffic mitigation measures are necessary.

Development waivers for any requirements? (roads, sidewalks, stormwater infrastructure, additional plans, traffic mitigation)

Tech committee recommends waivers for all development standards.

The Area Plan Commission (hereinafter referred to as “Board”) of White County, Indiana, at a public meeting, properly advertised pursuant to IC 5-3-1-2 and IC 5-3-1-4, having heard testimony and reviewed evidence related to the following request(s), does now enter the following

Findings of Fact:

 

1) The property is located in a B-2 General Business District;

2) A major subdivision is provided for by Chapters 3 and 5 of the White County Indiana Subdivision Control Ordinance;

3) A major subdivision is a permitted use for a B-2 District;

4) The proposal calls for two lots, Lot #1 and Lot #2, with Lot 1 proposed for auto parts retail; Lot 2 is currently used for home improvement retail;

5) Legal Description: A part of the Southeast Quarter of Section Thirty-Two, Township Twenty-Seven North, Range Three West in the City of Monticello, White County, Indiana (see file for boundary survey with full legal, Recorder’s instrument# 080100123);

6) The property lies in along U.S. Highway 24, in between two other commercial properties and general agriculture use to the immediate South;

7) The current use of the parcel is for a home improvement store with excess acreage;

8) The applicant provided a sketch plat for the area plan commission in accordance with the White county Indiana Subdivision Control Ordinance;

 

9) The applicant provided an initial plat for Tech Review which included proposed lot boundaries, lot sizes, proposed easements, minimum setback standards and other pertinent subdivision standards (see file for plat);

 

10) The initial plat was approved by the Board on March 28, 2017;

 

11) The applicant provided a secondary plat for Tech Review in accordance with Chapter 5 of the White County Subdivision Control Ordinance (see file for plat);

 

12) All changes and recommendations requested by the Tech Review Committee were incorporated into the plat;

13) The Applicant is not required to dedicate or reserve property to the public in B-2 zoning district;

14) The Applicant requested a waiver to the White County Subdivision Control Ordinance for subdivision development standards, specifically, Section 3.2.2 A.5, A.9, C, D, & E, Section 3.3.2 A.16, A.18, & B, and Section 3.5.

15) The Board unanimously approved the waiver request to the White County Subdivision Control Ordinance;

16) Proper notice of the subdivision request was given by mail to adjoining property owners;

17) The subdivision request was advertised in the paper as required by IC 5-3-1-2 and IC 5-3-1-4;

18) Parties in attendance at the hearing included Art Dragoo (property owner);

19) President Anderson opened the floor to the public; there being no other parties indicating a desire to speak, APC attorney Abigail Diener passed out ballots to the Board members for voting.

 

Ordinance Consideration Criteria

The Board determined that the Standards of the White County Indiana Subdivision Control Ordinance have been met.

 

For that reason, the Board gave FINAL APPROVAL of the request for a new subdivision to be identified as Hutton Subdivision, and it was so ordered, April 26, 2017.
