BZA MEETING
May 18, 2017

The White County Area Board of Zoning Appeals met Thursday, May 18, 2017, at 6:00 p.m. in the Commissioners’ Meeting Room, Second Floor, County Building, Monticello, Indiana.

Present: Randy Conwell, Chris McWhirter, Stan Minnick, Dennis Sterrett

Also attending were Executive Director Colin Betts, Board Secretary Annette Cobb, and Attorney Jim Hodson

Absent: Dave Rosenbarger

Visitors attending were: Doug Fleming and Jim Cade

The meeting was called to order by Vice Chairman Dennis Sterrett at 6:00 P.M.

Colin Betts introduced the new BZA Member, Chris McWhirter. Mr. McWhirter was appointed by the Monticello Mayor.

Minutes & Findings of Fact:

There was a motion by Randy Conwell and a second by Stan Minnick to approve the meeting minutes and findings of fact dated April 20, 2017 as written. Motion was carried unanimously.

Note: At the introduction of each case hearing, Director Betts introduced the Staff Report and affiliated documents into the official record of the meeting, to be used as supporting documents for developing the Findings of Fact for each hearing.

Variances & Special Exceptions

Variance Petition #2945- Stevenson’s Point-Applicant requested in writing a continuance to the June 15th meeting.

Variance Petition #2947-Charlie Roberts and Tim Schaffer-Ball Eggleston, representative of applicants, requested the hearing be continued to the June 15th meeting due to a scheduling conflict.

Variance Petition #2948

Executive Director, Colin Betts, read the staff report and presented photos of the subject site. There were no questions from the Board for Mr. Betts, so Doug Fleming stepped to the podium to represent his request. Mr. Fleming explained two of the busses that were presented in the pictures are used for detasseling corn and church trips. The other bus is being restored. They are older busses and he would like to protect them from the weather. The 13’ setback is needed because the lot tapers away from the house making it difficult to build any other place on the lot. Doug Fleming stated that the drive is a private drive that only services the four houses along Westwood Lane. He shared with the Board that he may in the future want to enclose the carport with sides and possibly an overhead door. He is aware that he would need to receive a building permit for this and he would want the structure to remain pleasing to the eye. Jim Cade stepped to the podium. Mr. Cade stated that he is Mr. Fleming’s neighbor and that he has lived in this neighborhood since 1973. He stated that the lane is maintained by the owners that the road services, and questioned the need for Mr. Fleming to apply for a variance. Mr. Cade supports Mr. Flemings plans to build the proposed carport, and pointed out that there is another building further down the lane that sits almost on the lane. Mr. Cade spoke highly of Mr. Fleming and encouraged the Board to grant his variance request.

When there were no further questions from the Board, Executive Director, Colin Betts passed out the ballots to vote on the variance request.

After tabulating the ballots, Vice Chairman Dennis Sterrett read the following results into the record:

Variance Petition #2948 -4 votes cast; 4 votes to grant, 0 to deny; Petition Granted

Other Business:

There being no further business, Dennis Sterrett made a motion the meeting be adjourned by Stan Minnick with a second from Chris McWhirter. Motion carried unanimously, meeting adjourned at 6:30 p.m.
