BE IT REMEMBERED, that the White County Drainage Board held a regular meeting on Monday, August 7, 2017. The meeting was held at the White County Building, 2nd floor, Commissioners’ conference room beginning at 10:30 a.m.Drainage Board members present were: President Steve Burton, Vice President John Heimlich and Board Member David Diener. Also, present were the White County Surveyor Bradley E. Ward, Attorney George Loy and Board Secretary Jennifer Hill.

Others present were:

President Burton called the meeting to order.

MINUTES

  • Vice President Heimlich made a motion to approve the minutes as presented for the regular meeting held on July 17, 2017, seconded by Board Member Diener.

OPEN BIDS/QUOTES

J.L. ACKERMAN #565

This is just a branch of the Ackerman not the whole thing, branch #6, branch #2 of #6, branch #3 of #6. There were two bids received. Attorney Loy opened the 2 bids:

County Line Excavating: $5,100.00

L R Excavating: $7,455.00

Surveyor Ward explained that his estimate was $10,000.00. He’s worked with both contractors before. Board Member Diener made a motion to accept the low bid of $5,100.00 from County Line Excavating, with a second from Vice President John Heimlich. Vote: Unanimous. (3 – Favor, 0 – Oppose)

RECONSTRUCTION HEARINGS

G. Riffle Branch OF H.A.B. MOORHOUS # 564

Phil Hunt has purchased a tract of land off of Hunt Farms and is wanting to develop that piece of property and would like to relocate the tile around the property. This would be at his own expense under the supervision of myself. President Burton opened the floor for comment. Mary McClellan, stood and spoke, she is an adjoining property she explained that she should be the first property to drain but is the last. Her concern was if the tile that was put in was smaller than the other it would create bigger problems for her property to drain.

There was no remonstrances received in regards to this request.

ADOPTION OF RECONSTRUCTION PROJECT

THERE BEING NO FURTHER DISCUSSION OR EVIDENCE TO BE SUBMITTED IN THESE PROCEDDINGS, THE CHAIRMAN WOULD NOW CONSIDER A MOTION TO DETERMINE THAT THE COSTS, DAMAGES, AND EXPENSES OF THE PROPOSED RECONSTRUCTION WILL BE LESS THAN THE BENEFITS ACCRUING TO THE OWNERS OF THE LANDS BENEFITTED BY THE RECONSTRUCTION.

THE WHITE COUNTY DRAINAGE BOARD THEREFORE ADOPTS THE RECONSTRUCTION REPORT OF THE WHITE COUNTY SURVEYOR AND THE SCHEDULE OF ASSESSMENTS, INCLUDING ANY ANNUAL ASSESSMENTS FOR PERIODIC MAINTENANCE. THE WHITE COUNTY DRAINAGE BOARD NOW ISSUES ITS WRITTEN FINDINGS AND ORDER DECLARING THE PROPOSED RECONSTRUCTION OF THE G. RIFFLE OF THE H.A.B. MOORHOUS DRAIN ESTABLISHED.

 

MAINTENANCE MODIFICATION HEARINGS

EDWIN COCHELL # 523

This ditch was petitioned in the spring. We had thought that there was enough money for the project but there isn’t. Annual assessment is about $440. We’ve recommended a rate of $5.00/ acre with a $10.00 minimum for 4 years and then at that time dropping back to $3.00/ acre with a $5.00 minimum. Everything was advertised and I believe were ready for the hearing. President Burton opened the floor for public comment. Helen George spoke in reference to history of the ditch, but didn’t have an opinion either way on the matter. Surveyor Ward explained that the intent is to dredge the ditch. There is about $2000.00 in the fund, the estimate for the project is about $10,000.00.

ADOPTION OF MAINTENANCE MODIFICATION FOR EDWIN COCHELL TILE DRAIN #523

I.C. § 36-9-27-42

THE WHITE COUNTY DRAINAGE BOARD HAVING HEARD AND CONSIDERED ALL THE EVIDENCE AND ANY OBJECTION SUBMITTED IN THESE PROCEEDINGS, THE CHAIRMAN WOULD NOW CONSIDER A MOTION FINDING THAT THE CURRENT ESTIMATE OF MAINTAINING THE EDWIN COCHELL TILE DRAIN #523 IS INSUFFICIENT AND THAT THE ANNUAL ASSESSMENTS FOR PERIODIC MAINTENANCE OF SAID DRAIN SHOULD BE INCREASED AS PROPOSED IN THESE PROCEEDINGS.

PETITION FOR MAINTENANCE

J.C. Vanatta Branch #1 #656

(President Steve Burton abstained from this vote.)Surveyor Ward explained that the Petition for Maintenance was carried by Barry Tolen and approximately 30% of the watershed had signed the petition. It was last cleaned in 2007. This drain is located in Round Grove Township and drains into the Big Pine ditch. Board Member Diener made a motion that the board accept the Petition for Maintenance on the J.C. Vanatta Branch #1 #656, with a second from Vice President Heimlich. Vote: (2 – Favor, 0 – Against, 1- abstained)

Rankin & Luckey Drain #627

The Petition for Maintenance was carried by MKR Farms. Approximately 30% of the watershed signed the petition (which was one landowner). It was last cleaned in 2010, mainly debrushing at the time however, part of it was dipped. There are 912 acres in the watershed, MKR has about 300 of those acres. There is currently $6200.00 in the fund and collection is currently off. Vice President Heimlich made a motion to accept the Petition for Maintenance on the Rankin & Luckey Drain #627, with a second by Board Member Diener. Vote: Unanimous (3 – Favor, 0 – Against)

OTHER BUSINESS

Buffalo Ponds

There was a group from Buffalo present in regards to the Buffalo Ponds and the problem with the silt. Three audience members spoke in regards to the issue, Walt Hough, Mike Radovich and Sharon Miller. The Drainage Board decided that a site visit should be made to assess the situation. There is no guarantee that the Board will be able to assist with the issue at hand.
