BZA MEETING
September 14, 2017

The White County Area Board of Zoning Appeals met Thursday, September 14, 2017, at 6:00 p.m. in the Commissioners’ Meeting Room, Second Floor, County Building, Monticello, Indiana.

Present: Randy Conwell, Chris McWhirter, Stan Minnick, Dennis Sterrett

Also attending were Executive Director Colin Betts, Board Secretary Annette Cobb, and Attorney Abigail Diener

Visitors attending were: Jerome & Edith Chudzicki

The meeting was called to order by Vice Chairman Dennis Sterrett at 6:00 P.M.

Minutes & Findings of Fact:

There was a motion by Randy Conwell and a second by Chris McWhirter to approve the meeting minutes and findings of fact dated August 17, 2017 as written. Motion was carried unanimously.

Note: At the introduction of each case hearing, Director Betts introduced the Staff Report and affiliated documents into the official record of the meeting, to be used as supporting documents for developing the Findings of Fact for each hearing.

Variances & Special Exceptions

Variance Petition # 2957- Executive Director Colin Betts read the staff report, reviewed the survey submitted with the request, and presented photos of the subject site. Mr. Betts alerted the Board to the possibility of stormwater infrastructure at or near the site, at the bottom of Hummingbird Drive, which was not surveyed or mapped. This information was not included with the variance submittal and was entered into the record during discussion of the site photos. There were no questions from the Board for Mr. Betts, so Mr. Chudzicki stepped to the podium to represent his request. Mr. Chudzicki stated that they are the original builders of the lake home that was constructed in 1994. Dennis Sterrett asked where vehicles turn around as this is a dead end road. Mr. Chudzicki answered that currently only the mailman turns around in his drive. Fed Ex/UPS back up and turn around on the farmland to the north of the subject property. Mr. Chudzicki also explained that the owners at 3270 Hummingbird, last home located on Hummingbird Drive, laid out their property to allow themselves and their visitors to turn around within their own property. Mr. Chudzicki also went into further detail about the storm drain shown in the photos, Twin Lakes Regional Sewer District (TLRSD) lines, and the NIPSCO easement. He believed that is was a private drain installed by his neighbor. Dennis Sterrett expressed concern over the parking for the garage. Would there be enough room if there were cars parked on the North side of the garage that they would be completely out of the roadway? Mr. Chudzicki explained that the survey does not display the actual width of the roadway. He believes there is plenty of clearance room as the road is actually a single lane road that was platted with a 40’ easement. When there were no further questions or comments from the Board, the Audience or the Applicant, Attorney Abigail Diener passed out the ballot to vote on the variance request.

After tabulating the ballots, Vice Chairman Dennis Sterrett read the following results into the record:

Variance Petition #2957 - 4 votes cast; 4 votes to grant, 0 to deny; Petition Granted

Other Business:

The BZA is currently one member short and needs a member appointed from the APC. Dennis Sterrett questioned who would be eligible to serve on the BZA from the APC. There was a short discussion about who would be eligible to be appointed.

There being no further business, Chris McWhirter made a motion the meeting be adjourned with a second from Stan Minnick. Motion carried unanimously, meeting adjourned at 6:21 p.m.
