BE IT REMEMBERED, that the White County Commissioners held a special meeting on Monday, January 8, 2018, in the White County Building, 2nd – floor Commissioners’ Conference Room, beginning at 8:00 a.m.

Commissioners present were: President John C. Heimlich, Vice President Steve Burton, and Commissioner David Diener. Also present was White County Auditor Gayle Rogers, White County Attorney George Loy, and the Commissioners’ Assistant Donya Tirpak.

Commissioner Heimlich called the meeting to order.


· Commissioner Diener made a motion to appoint George W. Green to the White County Aviation Board with a term expiring December 31, 2021, seconded by Commissioner Burton. Vote: Unanimous


Commissioner Heimlich said that Director Colin Betts signed a contract for software for the department when legally the contract should’ve been approved and signed by the commissioners.

County Attorney Loy discussed the issues that he had with the contract. He pointed out that the contract will automatically renew year-to-year unless either party cancels with written notice within 60-days of the renewal date.

IT Director Eric Storm said that nobody contacted his department to discuss the new software or the contract. He said that there’s going to be a lot of other costs involved because of everything that they will have to do in-house.

Director Betts said that he was not aware that the county would have to purchase additional equipment. His understanding is that everything will be online and no additional equipment, servers, are needed. The contract from Sidwell for $38,150 is for implementation and training of the software: permitting and inspection, code enforcement, planning, and zoning. The contract from Accela for $8,409 is the cost of the subscription and maintenance.

Commissioner Heimlich asked County Attorney Loy where they stand legally since Director Betts has already signed and submitted the contract.

County Attorney Loy said that Sidwell would probably have the county stick to the contract. He recommended sending a letter of termination to them now stating that it is not our practice to commit ourselves to renewable contracts. When the term expires, Director Betts needs to remember that the commissioners sign and approve all contracts.

· Commissioner Burton made a motion to approve the contracts from Sidwell and Accela for 2018 and to send a termination letter to Accela so the contract will not renew year-to-year, seconded by Commissioner Diener. Vote: Unanimous


Highway Superintendent Mike Kyburz presented a letter to the commissioners requesting them to accept Black Locust Ct. and Walnut Ridge Loop into the county highway road inventory.

Superintendent Kyburz said that they should be doing the maintenance on these two roads, but INDOT still needs to make the final approval. Until INDOT approves, the county will not receive reimbursement for the mileage.

Superintendent Kyburz explained that INDOT has a check-off list for accepting roads into their roadway system. Everything is checked off the list except for the commissioners’ approval.

Superintendent Kyburz said that he has around 40 roads that need to be entered into the county’s inventory. He’s going to try and enter the roads township by township.

County Attorney Loy said that he would like to write-up a resolution for each one so he can put the exact dimensions of the road.

The commissioners granted permission to submit the paperwork to INDOT for Black Locust Ct. and Walnut Ridge Loop as presented. PERMISSION GRANTED

There being no further business to come before the board, the commissioners adjourned their meeting.
