BZA MEETING
October 19, 2017

The White County Area Board of Zoning Appeals met Thursday, October 19, 2017, at 6:00 p.m. in the Commissioners’ Meeting Room, Second Floor, County Building, Monticello, Indiana.

Present: Randy Conwell, Chris McWhirter, Stan Minnick, Dennis Sterrett, and Abbey Gross

Also attending were Executive Director Colin Betts, Board Secretary Annette Cobb, and Attorney Abigail Diener

Visitors attending were: Rob & Deb McLeland, Dorean Bogdanich, Crystal Luckman, John Scott, and Wendy Gibson

The meeting was called to order by Vice Chairman Dennis Sterrett at 6:00 P.M.

Minutes & Findings of Fact:

There was a motion by Chris McWhirter and a second by Stan Minnick to approve the meeting minutes and findings of fact dated September 14, 2017 as written. Motion was carried unanimously.

Business:

New Member Introduction- Abbey Gross was introduced as the appointed member from the APC for the vacant position left by Dave Rosenbarger.

Note: At the introduction of each case hearing, Director Betts introduced the Staff Report and affiliated documents into the official record of the meeting, to be used as supporting documents for developing the Findings of Fact for each hearing.

Variances & Special Exceptions

Variance Petition #2958-Withdrawn

Variance Petition # 2960

Executive Director Colin Betts read the staff report and presented photos of the subject site. Director Betts explained that this request is for a 0.5’ front (waterside) setback for the placement of a new dwelling with an attached enclosed porch. Mr. Betts explained that the porch would make it part of the principle structure for setbacks if enclosed. According to The White County Zoning Ordinance setbacks are measured from the foundation to the property line when the eave is 16” or less. He also explained that any overhang over 6” would encroach SFLECC property according to the submitted survey. Ms. Crystal Luckman Smith, the applicant, stepped to the podium to represent her request. Ms. Smith explained that she had wished to use the existing foundation of the previous dwelling but the insurance company deemed it unacceptable, therefore it had to be completely removed. She went on to explain that the prior deck had actually encroached 2’ into SFLECC owned land, but the new plan brings all of the structure within her property boundary. When there were no further items to consider Abigail Diener passed out the ballot to vote on the variance request.

After tabulating the ballots, Vice Chairman Dennis Sterrett read the following results into the record:

Variance Petition #2959 -5 votes cast; 5 votes to grant, 0 to deny; Petition Granted

Variance Petition # 2960

Executive Director, Colin Betts, read the staff report and presented photos of the subject site. Director Betts explained that this request is for a new dwelling with a 22’ front (waterside) setback and an 11.5’ rear (roadside) setback. There were no questions from the Board for Mr. Betts, so Robert McLeland stepped to the podium to represent his request. The current dwelling will be removed and replaced with a larger dwelling. Abigail Diener asked Mr. McLeland if he would like his requests heard separate or together. Mr. McLeland requested both requests be voted on at once. Abigail Diener passed out the ballot for the combined variance request.

After tabulating the ballots, Vice Chairman Dennis Sterrett read the following results into the record:

Variance Petition #2960 -5 votes cast; 5 votes to grant, 0 to deny; Petition Granted

Other Business:

There being no further business, Randy Conwell made a motion the meeting be adjourned with a second from Stan Minnick. Motion carried unanimously, meeting adjourned at 6:40 p.m.
