APC MEETING – August 13, 2018

The White County Area Plan Commission met Monday, August 13, 2018, at 6:00 p.m. in the Commissioners’ Meeting Room, Second Floor, County Building, Monticello, Indiana.

Board Members Present: Charles Anderson, James Annis, Rodger Brouwer, Abbey Gross, Richard Lynn, Doug Pepple, Stacy Selagy, Mike Smolek, Dennis Sterrett & Brad Ward.

Planning Department Representatives: Colin Betts, Executive Director; Tina M. Tiede, APC Secretary; and Abigail Diener (Attorney)

The meeting was called to order by APC President Charlie Anderson. The power went out in the building and the meeting was not audio recorded.

Approval of The Minutes: There was a motion by Brad Ward and a second by Rodger Brouwer to approve the meeting minutes of the 07/09/18 APC Regular Meeting. Approved unanimously, so moved.

REZONES:

#1086 – William J Misenheimer: B-2 (General Business District) to B-4 District (General Business Dense Development Residential) – 221 & 225 W Broadway St., Monticello IN, 47960; Union Township. The rezone request is to bring the current property which has dense commercial development and is not able to reasonably comply with B-2 district developmental standards in the case of a catastrophic event.

Colin Betts read the Staff Report into record. The property currently has a building that was originally built in 1952, having several additions and remodels completed after the 1974 tornado. It currently is home to State Farm Insurance office and Misenheimer Medical Clinic, which share a common wall. Medical (including chiropractic) and Professional Office are permitted uses in both the B-2 and B-4 zoning districts. The present use is commercial personal/professional services.

William Misenheimer was present to represent the request for rezone. Joseph Rogers suggested to the Board a negative recommendation to the rezone request but stated reasons he felt the Variance process was a better option. After some discussion, William Misenheimer withdrew his request for rezone and will meet with Colin Betts to discuss alternative options for this parcel.

AMENDMENTS:

1) Zoning Ordinance Amendment #A54 – I-3 Developmental Standards and Regulations: CH 3 Specific Use Requirements and Performance Standards – 3.14 I-3 Zoning District & 3.15 General Performance Standards; CH 14 – Definitions; Appendix A-Official Schedule of Uses; Appendix B-Bulk Use Chart.

Joseph Rogers was present to represent the amendment, on behalf of the White County Commissioners. Amendment #54 is intended to establish additional developmental standards and regulations pertaining to I-3 zoned properties with an emphasis on desirable criteria for development of the Mid America Commerce Park. The amendment adds several specific uses to Appendix A inclusive of definitions for each. The amendment proposes multiple changes, additions and clarifications for Chapter 3, Section 3.14 & 3.15, Chapter 14 and Appendix A & B.

Additions to Section 3.15, General Performance Standards, were proposed to accommodate expectations of changes to the County Nuisance Ordinance and establishment of an Odor Ordinance. These ordinances will likely impact multiple zoning districts and land use categories.

There are several Definition additions and one definitional change. Appendix A and B have been modified to incorporate these additions and changes as well as to add a minimum building square footage requirement for the I-3 District classification.

Randy Mitchell, White County Economic Development President, expanded on the desirable future development for the Mid America Commerce Park and reiterated the importance of this amendment.

Mike Smolek expressed an issue with the definition term “Agri-Animal Production” and after some discussion, it was decided to change the term to “Agri Bio Production”.

The APC voted to approve this amendment 10-0 by a show of hands.

2) Zoning Ordinance Amendment #A55 – Parties Entitled to Initiate a Rezone Amendment: CH 12 Administrative – 12.8.3 Parties Entitled to Initiate Amendments.

Joseph Rogers was present to represent the amendment, on behalf of the White County Commissioners. Amendment #55 is intended to clarify the intent of Chapter 12, Section 12.8, Subsection 12.8.3 which provides a property owner(s) with the ability to assign a designee for the purpose of rezoning one or more of his and/or her properties.

The amendment provides and new form to supplement the existing application process and specific language required to establish that the property owner(s) is actually initiating the rezone request vs simply not objecting to another party initiating a rezone of his/her property(ies).

The APC voted to approve this amendment 9-0 by a show of hands.

BUSINESS:

1) Charles Anderson requested an Executive Session Meeting to discuss employment issues. The meeting will be held on Tuesday, August 21st at 6:00 p.m. Tina Tiede will contact the Monticello Chamber of Commerce to request permission to use their conference room.

There being no further business, Charles Anderson made a motion to adjourn the meeting, with a second from Brad Ward. The meeting adjourned at 7:30 p.m.
