APC MEETING – October 9, 2018

The White County Area Plan Commission met Monday, October 9, 2018, at 6:00 p.m. in the Commissioners’ Meeting Room, Second Floor, County Building, Monticello, Indiana.

Board Members Present: James Annis, Rodger Brouwer, Abbey Gross, Doug Pepple, Stacy Selagy, Dennis Sterrett & Brad Ward. Absent: Charles Anderson, Richard Lynn, & Mike Smolek

Planning Department Representatives: Joseph Rogers, Executive Director, Tina M. Tiede, APC Secretary; and Abigail Diener (Attorney)

The meeting was called to order by Area Plan Executive Director, Joseph Rogers.

Approval of The Minutes: There was a motion by Abbey Gross and a second by Brad Ward to approve the meeting minutes of the 09/10/18 APC Regular Meeting. Approved unanimously, so moved.

REZONES: NONE

SUBDIVISIONS:

#SA090718 – Bertram: Application for Approval of Subdivision Plat Covenants, Conditions, and Restrictions for Lots 1-4 in Hallsdale Addition. Said subdivision, recorded under Plat Record No #74SUR2050, involves the following described real estate in Hallsdale Addition Lots 1-4; Union Township; White County, Indiana.

Joseph Rogers read the September 25, 2018 White County Tech Review Committee Meeting Minutes into the record (see permanent file). The purpose of the meeting was to review a proposal for an amendment to the plat of Hallsdale Addition for the purpose of modifying front setback requirements for Lot 3. After extensive discussion, it was decided that Tech Review would recommend to the Area Plan Commission that this request be approved and handled via a Covenant and Restriction document that modifies the building setbacks for all 4 (four) lots in Hallsdale Subdivision vs a revised subdivision or lot plat.

Applicant, Roger Bertram, was in person to represent this request. Roger stated that the purpose of the request was to allow for a home addition. The Board had no additional questions for the applicant and there were no additional questions from the public. Doug Pepple made a motion to accept the amended Subdivision Plat Covenants, Conditions and Restrictions for Lots 1-4 in Hallsdale Addition. Jim Annis seconded that motion with all Board Members unanimously approving; Motion carries.

AMENDMENTS: NONE

BUSINESS:

1) BZA Appointment – Appoint BZA representative for the next term

Abbey Gross is the current BZA appointment from APC membership that is a citizen member. Doug Pepple made a motion to nominate Abbey Gross to another term, with a second from Denny Sterrett. All Board Members were in favor by show of hands; motion carries.

2) 2019 Meeting Schedule – Approve the 2019 APC Meeting Schedule

Abbey Gross made a motion to approve the proposed 2019 APC Meeting Schedule, with a second from Jim Annis. All Board Members were in favor by show of hands; motion carries.

3) Open Activities – Amendments, Signage, Parking, and Violations.

4) Transition Plan – Implementation of a transition plan for Executive Director replacement

Director, Joe Rogers, suggested that a small board of APC members be selected to meet and discuss the transition options for the replacement of the Executive Director and present the suggested option to the Board for final approval. A motion was made by Doug Pepple to appoint Jim Annis, Brad Ward, & Stacey Selagy to the Transition Committee. Rodger Brouwer seconded the motion with all Board Members unanimously approving; Motion carries. (Following the meeting, Joe Rogers also asked Abbey Gross to sit on the committee and she agreed.)

There being no further business, Doug Pepple made a motion to adjourn the meeting, with a second from Jim Annis. The meeting adjourned at 6:48 p.m.

Applicants request a revision of setback standards.

PURPOSE

The amendment request is to allow application of current county setback standards to all lots and to provide additional room for development.

HEARING DATE

October 9, 2018

The Area Plan Commission (hereinafter referred to as “Board”) of White County, Indiana, at a public meeting, properly advertised pursuant to IC 5-3-1-2 and IC 5-3-1-4, having heard testimony and reviewed evidence related to the following request(s), does now enter the following Findings of Fact:

1) The subdivision is property is located in an R-2, Single & Two-Family Residential District;

2) The subdivision is identified as Hallsdale Addition, which is a 4-lot subdivision which was recorded on May 9, 1974;

3) The property lies in a geographic area primarily dedicated to residential and agricultural uses;

4) The current use of the lots is as single-family dwellings;

5) The properties impacted by the request are as follows:

a) Lot 1, Hallsdale Addition, Parcel ID #: 91-73-22-000-008.000-020

b) Lot 2, Hallsdale Addition, Parcel ID #: 91-73-22-000-012.600-020

c) Lot 3, Hallsdale Addition, Parcel ID #: 91-73-22-000-009.200-020

d) Lot 4, Hallsdale Addition, Parcel ID #: 91-73-22-000-011.400-020

6) The applicant provided an Amended Plat Survey dated September 5, 2018 reflecting the applicant’s requested revisions and changes requested; these changes consisted of a change in setback standards to the current county setbacks.

7) Joe Rogers read into the record the minutes of the Tech Review Committee Meeting held on September 25, 2018 (see file); It was decided that Tech Review would recommend to the Area Plan Commission that this request be approved and handled via a Covenant and Restriction document vs a revised subdivision or lot plat;

8) Proper notice of the amendment request was given by mail to adjoining property owners;

9) The amendment request was advertised in the paper as required by IC 5-3-1-2 and IC 5-3-1-4;

10) The Staff received communications from the general public documented in a Citizen Feedback Log (see file);

11) Rodger Bertram, applicant, spoke on behalf of the request; The Board had no questions for the applicant;

12) There were no members of the public that spoke to this request;

13) Having no further questions, the Board moved to vote on the recommendation of the Tech Review Committee.

Ordinance Consideration Criteria

1) The Board concludes that the application and documentation package is complete and requires no additional information;

2) The Board confirms that an Amended plat and detailed description of the proposed changes to the subdivision were submitted in addition to the completed Application for Amended Subdivision Plat Approval; and,

3) The Board refers to Tech Review approval as confirmation that an impact statement was submitted summarizing the effect of all changes including covenants, restrictions, or commitments.

For all the foregoing reasons, the Board APPROVED the request to amend the subdivision plat, and it was so ordered, October 9, 2018.
