BE IT REMEMBERED, that the White County Drainage Board held a meeting on Monday, March 4, 2019. The meeting was held at the White County Building, 2nd floor, Commissioners’ conference room beginning at 10:30 a.m. Drainage Board members present were: President Steve Burton, Vice President John Heimlich and Board Member David Diener. Also, present were the White County Surveyor Bradley E. Ward, Attorney George Loy and Board Secretary Jennifer Hill.

President Steve Burton called the meeting to order.

· Vice President Heimlich made a motion to approve the minutes as presented for the meeting held on February 19, 2019, seconded by Board Member Diener Vice President Heimlich.

REQUEST FOR RIGHT TO ENCROACH AND REDUCTION IN EASEMENT- JOHN BROWN DRAIN #722

Surveyor Ward introduced Kris Holeyfield, Veridus Engineering who is presenting the information on behalf Performance Services, INC. North White School is wanting to install a solar farm north east of the ball fields. Performance Services is requesting a Reduction in the Easement for the John Brown tile and a Right to Encroach. Mr. Holeyfield explained what they’re requesting is a reduction on the East side of the Easement down to 30’ on the east side and this would allow all of the solar panels to be on the east side of the drain for installation and in addition to the reduction we’re requesting Right to Encroach and this is due to the placement of a chain link fence, that they install 10’ outside of the panels and that is more for security to keep people and animals out of the zone of the panels Mr. Holeyfield further explained that they plant a grass seed under the panel that is not a tall grass, so there is only 1 or 2 times of maintenance where it needs to be mowed. It was determined that the reduction in easement really only needed to occur on the east side of the drain and the 75’ easement could remain on the west. The Right to Encroach is for the fence. If work needs to be done on the drain then it would be at North White’s expense to remove the fence for the work to be done, Mr. Holeyfield stated that North White was aware of that information. Attorney Loy advised he would need the deed for the property, a $25 for the recording fee, and a $75 for the Right to Encroach and Reduction in Easement for the Surveyors Department. Tony Cain who was present in the audience suggested that they find out what kind of root system this grass that will be planted has. Mr. Holeyfield stated that he would find out the species of the grass and communicate that with Surveyor Ward. There was a motion by Vice President Heimlich that the Right to Encroach and the Reduction in Easement be granted, with a second from Board Member Diener contingent on receiving information on the kinds of grass and the easement being recorded. Vote: Unanimous (3- favor 0-Oppose)

There being no other business before the board, the meeting was adjourned.
