BE IT REMEMBERED, that the White County Drainage Board held a meeting on Monday, June 17, 2019. The meeting was held at the White County Building, 2nd floor, Commissioners’ conference room beginning at 10:30 a.m. Drainage Board members present were: President Steve Burton, Vice President John Heimlich and Board Member David Diener. Also, present were the White County Surveyor Bradley E. Ward, Attorney George Loy and Board Secretary Jennifer Hill.

 

President Steve Burton called the meeting to order.

MINUTES

· Board Member Diener made a motion to approve the minutes as presented for the meeting held on June 3, 2019, seconded by Vice President Heimlich.

Vote: Unanimous (3 – For, 0 – Against)

MAINTENANCE MODIFICATION –set rates

This starts at Chalmers Road and runs up to Hanenkratt Elevator then over to Reynolds. There is a decent watershed but have multiple repairs on this each year. Surveyor Ward explained that his proposal is a short increase of $5.00 an acre with a $10.00 minimum, two years would get us out of debt. Then lowering it to $2.50/ acre. The current rate is 1.00 an acre with the current annual assessment of $4,757. To date we’ve removed 2 beaver dams, taken trees off, 5 outlet repairs and 2 tile hole repairs so far this year.

There was a motion by Vice President Heimlich to accept the low bid from JLED on the James Carter #621 laterals; with a second from Board Member Diener. There was a motion by Vice President Heimlich that we send out notices with that proposal of $5.00/ acre with a $10.00/ minimum for two years then dropping back to $2.50; with a second from Board Member Diener. Vote: Unanimous (3 - For, 0 - Against).

Surveyor Ward explained that it’s been petitioned to be cleaned. It was surveyed this spring. Currently there is $10,781 in the fund. The estimate for doing the job is around $50,000 (that’s $1.50 ft and taking brush off). Surveyor Ward proposed $5.00/ acre $10.00/ min and then drop that back to $2.00/ acre $5.00/ minimum. Vice President Heimlich made a motion to set the rates at $5.00/ acre with a $10.00/minimum for 4 years and then dropping back to a $2.00/ acre and $5.00/ minimum; with a second from Board Member Diener. Vote: Unanimous (3 - For, 0 - Against).

 

MAINTENANCE MODIFICATION HEARING

Surveyor Ward explained was petitioned by Larry Anderson on October 25, 2018, the White County Drainage Board accepted the petition on March 18, 2019. We have it surveyed and have the grades and design on it. This ditch runs completely through agricultural ground and we used the historical profile to come up with the grade. In the watershed there are 11 parcels, 279 benefitted acres, current rates are $2.00 acre with a $5.00 minimum, current balance is $2,276.43, there is no money owed in the Repay. The annual assessment is $558.00 we advertised at a rate of $15.00/ acre with a $15.00/ minimum. We have had two landowners contact the office. Larry Anderson who requested more information and a Genevieve Deno in regards to her assessment, she didn’t believe that she had any acres in the watershed. We reviewed the information and found that she does have 6 acres in the watershed so we believe that her assessment is correct. We have received no written remonstrances. The 4 year total at the $15.00/ acre is $4,185 and then after 4 years that would revert back to $2.00/ Acre with a $5.00/ minimum.

 

ADOPTION OF MAINTENANCE MODIFICATION

THE WHITE COUNTY DRAINAGE BOARD HAVING HEARD AND CONSIDERED ALL THE EVIDENCE AND ANY OBJECTION SUBMITTED IN THESE PROCEEDINGS, THE CHAIRMAN WOULD NOW CONSIDER A MOTION FINDING THAT THE CURRENT ESTIMATE OF MAINTAINING THE ISSAC BENJAMIN #723 DRAIN IS INSUFFICIENT AND THAT THE ANNUAL ASSESSMENTS FOR PERIODIC MAINTENANCE OF SAID DRAIN SHOULD BE INCREASED AS PROPOSED IN THESE PROCEEDINGS.

SO MOVED, BY BOARD MEMBER DIENER

SECONDED, BY VICE PRESIDENT HEIMLICH

THE WHITE COUNTY DRAINAGE BOARD BY A VOTE OF 3 IN FAVOR AND 0 OPPOSED NOW HEREBY ADOPTS THE SCHEDULE OF ASSESSMENTS AS ORIGINALLY FILED HEREIN (OR AS AMENDED). THE WHITE COUNTY DRAINAGE BOARD ISSUES ITS WRITTEN FINDINGS AND ORDER DECLARING THE PROPOSED MAINTENANCE MODIFICATION SCHEDULE IN THESE PROCEEDINGS ESTABLISHED, A COPY OF WHICH WILL BE MAILED TO ALL OWNERS AFFECTED.

 

There being no other business before the board, the meeting was adjourned.
