BE IT REMEMBERED, that the White County Commissioners held a regular meeting on Monday, May 4, 2020, in the White County Building, 2nd-floor Commissioners’ Conference Room, beginning at 8:15 a.m.

Due to the public health emergency in the State of Indiana because of COVID-19, County Commissioner President Heimlich and Commissioner Diener was present at the meeting. Commissioner Burton attended the meeting electronically according to I.C. §5-14-1.5-3.6(c), (f), (g) & (h). Also present was White County Attorney George Loy and Commissioners’ Assistant Donya Tirpak. County Auditor Gayle Rogers, Highway Superintendent Mike Kyburz, attended the meeting electronically.

MINUTES

· Commissioner Diener made a motion to approve the minutes for the regular meeting held on April 20, 2020, seconded by Commissioner Burton. Vote: Unanimous

PAYROLL

· Commissioner Diener made a motion to approve payroll for May 4, 2020, seconded by Commissioner Burton. Vote: Unanimous

CLAIMS

· Commissioner Burton made a motion to approve and pay the claims for May 4, 2020, as presented, seconded by Commissioner Diener. Vote: Unanimous

HIGHWAY DEPARTMENT

Highway Superintendent Mike Kyburz presented the 2019 White County Highway Department’s Annual Operation Report for local roads, streets, and bridges.

· Commissioner Burton made a motion to approve the 2019 White County Highway Department’s Annual Operation Report for local roads, streets, and bridges, seconded by Commissioner Diener. Vote: Unanimous

ACCEPT BIDS - COMMUNITY CROSSINGS PAVING PROGRAM

County Attorney George Loy announced that the time has expired for the submission of bids for White County’s Community Crossings Paving program.

Bids were received from the following:

1. Rieth-Riley Construction Co., Inc., $1,468,967.30 Project Base Total

Lafayette, IN $1,297,872.30 Project Total with Alternates

2. Central Paving, Inc.,                                 $1,553,959.60   Project Base Total

Logansport, IN $1,406,993.60 Project Total with Alternates

3. Milestone Contractors, LP $1,610,231.40 Project Base Total

Lafayette, IN $1,437,685.40 Project Total with Alternates

All bids will be taken under advisement and awarded at the next meeting on May 11, 2020.

CYBERSECURITY SERVICES AGREEMENT

County Attorney Loy presented an agreement between the Indiana Secretary of State, Carahsoft Technology Corp., FireEye, Inc., and Mandiant and White County. The agreement will provide cybersecurity services for the election software system, and there is no cost to the County. The agreement expires on December 31, 2022.

· Commissioner Burton made a motion to approve the Cybersecurity Services Agreement between the Indiana Secretary of State, Carahsoft Technology Corp., FireEye, Inc., and Mandiant and White County as presented, seconded by Commissioner Diener. Vote: Unanimous

COUNCIL ON AGING – PUBLIC HEARING

Council on Aging Director Gale Spry submitted a resolution requesting approval to apply for a grant with INDOT to purchase a new minivan. The cost of the minivan will be $42,00, with $33,600 coming from the grant and $8,400 raised by Council on Aging.

Commissioner Heimlich asked if there was anyone present that would like to comment about the grant application. No response.

· Commissioner Diener made a motion to adopt Resolution No. 20-05-04-1, authorizing the filing of an application for a grant under Section 5311 of the Federal Transit Act, as amended, seconded by Commissioner Heimlich. Vote: Unanimous

 

RESOLUTION NO. 20-05-04-1

RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR A GRANT UNDER

SECTION 5311 OF THE FEDERAL TRANSIT ACT, AS AMENDED

WHEREAS, the U.S. Department of Transportation is authorized to make grants to states through the Federal Administration (FTA) to support capital, operating and feasibility study assistance projects for non-urbanized public transportation systems under Section 5311 of the FTA Act of 1964, as amended;

WHEREAS, the Office of Transit, Indiana Department of Transportation (INDOT) has been designated by the Governor to make Section 5311 grants for public transportation projects;

WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provision by it of the local share of project costs;

NOW, THEREFORE, BE IT RESOLVED BY WHITE COUNTY:

1. That John C. Heimlich, County Commissioner, on behalf of White County is authorized to make the necessary assurances and certifications and be empowered to enter into an agreement with INDOT for the provision of rural public transportation services.

2. That White County Council on Aging is authorized to execute and file an application on behalf of White County Commissioners with the INDOT to aid in the financing of transit assistance projects pursuant to Section 5311 of the Federal Transit Act, as amended.

3. That White County Council on Aging is authorized to furnish such additional information as INDOT may require in connection with the application.

4. That White County Council on Aging is authorized to execute grant contract agreements on behalf of White County.

AWARD BID - COUNTY ROAD 1100

Brian Pohlar, HWC Project Engineer, called in electronically and said that three bids were received and reviewed for the White County CR 1100 project. He made the recommendation to award the low bid was from F&K Construction for $2,433,221.00.

· Commissioner Diener made a motion to award the bid to F&K Construction for $2,433,221.00, seconded by Commissioner Burton. Vote: Unanimous

AWARD BID – BRIDGE 227

Highway Superintendent Mike Kyburz said that two bids were received for the Bridge #227 project, CR 300 E. over Moots Creek in Prairie Township. The proposals were reviewed, and Superintendent Kyburz made the recommendation to award the bid to the low bidder, Milestone Contractors. The proposal was $3,788,000.00, with a decrease of Bid Alternate 2, $20,000.

Superintendent Kyburz said that they are going to proceed with Bid Alternative 2, maintaining road closure through the winter of 2020/21.  As detailed in Bid addendum 2, the time requirements for completion are substantial completion date for this alternative would be May 1, 2021, for all work and final acceptance May 28, 2021.  Given the $20,000 credit offered in the bid, the awarded contract amount is $3,768,000.00.

· Commissioner Burton made a motion to award the bid for the Bridge #227 project to Milestone Contractors for $3,768,000, seconded by Commissioner Diener. Vote: Unanimous

COMMUNITY CORRECTIONS ANNUAL REPORT

Director Alice Livesay called in electronically to present the 2019 Community Corrections report. A copy of the information is on file in the Commissioners’ Office.

· Commissioner Diener made a motion to accept the 2019 Community Corrections Annual report, as presented, seconded by Commissioner Heimlich. Vote: Unanimous

LOCAL DISASTER EMERGENCY DECLARATION EXECUTIVE ORDER

Commissioner Diener said that a meeting would be held with other governmental entities and the White County Health Department to discuss amending and extending White County Commissioners’ Executive Order No. 20-02 due to the COVID 19, coronavirus.

There being no further business to come before the board, their meeting adjourned.
