The White County Drainage Board convened at 10:30 A. M., EDT in the Commissioners’ Room of the White County Building, Monticello, Indiana with Board Members Steven Burton, O. D. “Bud” Ferguson and John C. Heimlich, Attorney George W. Loy, Drainage Assistant Mary E. Sterrett and Secretary Romana Kiser in attendance. Also attending were Jeff Ward and Charlie Mellon.

Board Member Ferguson made a motion to approve the minutes of the November 6, 2006 meeting. Board Member Heimlich seconded the motion. The motion carried unanimously.

Drainage Assistant Sterrett stated, “We need a Consent to Encroach for the Northbrooke Condominiums on the James Carter Ditch.” Chairman Burton stated, “The way we left it, from the last meeting, John (Heimlich) said he would like to get out and look at it.” Board Member Heimlich said, “And also get an engineering report. We did meet out there on Friday, November 10th. Todd (Engineer Frauhiger) was up and we met out at the site and it was Todd’s opinion that it was alright to grant the Consent to Encroach, that it wasn’t likely that we would get any future erosion there. Although, I don’t know if he has gotten back to you (Jeff Ward) at all, but he was going to make some suggestions on some things that might be done on that bank nearest the condo to ensure that no erosion took place. The measurement, we’ve been talking fifteen feet in here; the actual measurement is about twenty feet from the edge of the bank. And of course the stream is clear on the other side. So, it is our recommendation, looking at that, that we grant the Consent to Encroach.”

Board Member Heimlich made a motion to grant a Consent to Encroach to Northbrooke Condominiums. Board Member Ferguson seconded the motion. The motion carried unanimously. Attorney Loy told Jeff Ward, “I will be preparing the paper work and because of the situation, it will be both, for yourselves and the Waymouths to sign. (Jeff Ward indicated agreement.) Basically, it will say that the Board consents to this specific construction within twenty feet and we will attach a copy of the site survey. You and the Waymouths understand that if down the road there are any problems unique to the placement of the structure, because it is too close, then you guys bear that expense that the County would incur for maintenance. I’ll get it to you.” Jeff Ward responded, “Ok.”

Drainage Assistant Sterrett stated, “Denny (Surveyor Sterrett) had one more thing to ask about and that was the Buss Ditch, the Monticello Sewers. It was ok’d to give them a Consent to Encroach, but the document was never written. It was in the minutes. They still need that document.”

Board Member Heimlich reported that he attended the Monon Ditch Joint Board meeting last Thursday. He said they hired Jeff Healy, Banning Associates, to do engineering work and he thought that within a month he would have recommendations to us on limiting the digging on the south end and on the disposition of the silt trap, whether to go with what has been proposed or whether to move it farther upstream. They will be waiting on that for the next month or so and then go from there.

Chairman Burton adjourned the meeting.
