The White County Drainage Board convened at 10:30 A. M. in the Commissioners’ Room of the White County Building, Monticello, Indiana.  Board members present were:  President Ronald Schmierer, Vice President Steve Burton, and Drainage Board Member John Heimlich.  Also present were Attorney George W. Loy, Surveyor Dennis Sterrett, Drainage Assistant Mary Sterrett, and Secretary Jamie Rozzi.  

Also in attendance was Mike Smolek.

The first item on the agenda was to approve the minutes from the October 4th, 2010 meeting. Board Member Heimlich so moved.  Board Member Burton seconded the motion.   Motion carried unanimously.

The next item on the agenda was a Feasibility Hearing for combining Branch #1 and #2 of J. M. Timmons Branch #4 with J. M. Timmons Branch #4.  

Chairman Schmierer stated, “I guess we’re trying to put it on maintenance.”

Surveyor Sterrett explained, “Yes, that’s what we’re trying to do.  Branch #1 of 4 and Branch #2 of 4 is not on maintenance with Branch #4.”

Mr. Smolek asked, “Two of those culverts got replaced during the flood, is that correct?  I know one of them did.  When was that flood, two or three years ago?  This one was the main one, it took it out and it took that one out.  I don’t know how that all….I don’t know if FEMA paid for that or how that all got…I thought you came out there…”

Surveyor Sterrett replied, “No…”

Mr. Smolek stated, “Remember?  It took out that whole bank of the Timmons and everything.  The water went through the culvert and up over top of the ditch bank.”

Surveyor Sterrett asked, “2008? And we fixed it?  I don’t remember that one.”

Surveyor Sterrett explained, “Somebody has an open ditch right here…and it looks like it intercepts the tile.  Last time I was out there…there was corn and I didn’t get a chance to look at it.  So, this is the ditch that Ploss wants cleaned and there is a lot of brush on it here.”

Mr. Smolek replied, “Yes, on both sides.  And then it stops over there on Penn’s.  There might be a tile that comes off that which goes into Miller’s Tree Farm.”

Surveyor Sterrett replied, “The end of it is here, according to our legal description.”

Mr. Smolek stated, “There is another 100 to 500 feet that goes out into that field.”

Surveyor Sterrett stated, “That wouldn’t be put on maintenance.”

Mr. Smolek stated, “You might as well put it on there.”

Surveyor Sterrett stated, “Well, you’d have to change the legal description.  We didn’t advertise it like that.”

Mr. Smolek asked, “On those tile lines…I know that they’ve connected on to Stallard’s and went back over to this by Stangle’s.  Are they going to pay maintenance to, or how does that work?”

Surveyor Sterrett replied, “Well, they are paying maintenance now.  Everyone in this watershed is already paying maintenance.”

Mr. Smolek stated, “Basically all you’ve got is what the county has, but you know there is probably more tile that is connected to that.”

Surveyor Sterrett stated, “There might be tile connected, but they should notify the Surveyor’s Office if they change the watershed--if they go outside of what they are being assessed now.  Everyone is already assessed on Branch #4.  It’s just that when Branch #4 was put on maintenance they didn’t include Branch #1.  In 1978 the Surveyor’s Office had drawn a plan, but by the time they got it done the note on the bottom on the plan said that Branch #1 had been cleaned by the landowners.  So, they didn’t put it on maintenance because when they did the Reconstruction of Branch #4 they put it on maintenance.  Since Branch #1 was already clean they didn’t put it on maintenance.  So, we’re trying to get it on maintenance today.”

Mr. Smolek stated, “I agree with you, put it on maintenance.”

Surveyor Sterrett stated, “We notified all of Branch #4 watershed.”

Board Member Heimlich asked, “So this was just an unofficial hearing…in order to do this we’d have to have a hearing?”

Surveyor Sterrett stated, “No, this is what we notified the people for.”

Board Member Heimlich stated, “So this is the official hearing…I didn’t know that.”

Surveyor Sterrett stated, “Yeah, we notified everybody.”

Board Member Heimlich stated, “Well, it said feasibility hearing and that’s why I didn’t…”

Surveyor Sterrett asked, “Well, does that mean it’s not an official hearing?”

Attorney Loy stated, “If you sent them notice of what you’re doing here today, it’s fine.  It’s for the purpose of combining these all into one watershed.”

Board Member Heimlich made a motion to combine Branches #1 and #2 of Branch #4 with J. M. Timmons Branch #4 for periodic maintenance.  Board Member Burton seconded the motion.  Motion carried unanimously.

Chairman Schmierer asked if there was anything for the Drainage Board.  Chairman Schmierer then adjourned the meeting.
