APC MEETING NOVEMBER 8, 2010

The White County Area Plan Commission met Monday, November 8, 2010, at 7:00 p.m. in the Commissioners’ Meeting Room, Second Floor, County Building, Monticello, Indiana.

Members attending were:  Don Ward, Richard Lynn, Mike Smolek, Dave Scott, Dennis Sterrett, Gerald Cartmell, Greg Bossaer.  Absent:  Dave Rosenbarger, Charlie Anderson, Jim Mann

Also attending were Attorney Ben Diener, Executive Director Joe Rogers, and Secretary Gayle Rogers.

Visitors attending were:  None 

The meeting was called to order by Secretary Don Ward. The meeting minutes of October 12, 2010 were approved as written.

There were no rezones or subdivisions on the docket.

Business

BZA Appointment

Director Joe Rogers explained that the APC is to select a citizen member of its board to serve on the BZA (Area Board of Zoning Appeals).  A citizen member is one who holds no elected or appointed office.  With the current membership, Charlie Anderson, Don Ward and Greg Bossaer are the only eligible candidates.  Membership of the APC is expected to undergo some changes as of the beginning of 2011 and there should be at least one additional citizen member at that time.  Does the board prefer to select now or wait until January?  Dave Scott made a motion to table the BZA selection until the January APC meeting.  Gerald Cartmell seconded.  The motion passed (7-0) unanimously.

Amendment to Chapter 10, Signs

As requested in the October 12, 2010 meeting, Joe took photos of signs that would still be in violation with the proposed amendment submitted by the Citizens’ Advisory Committee. 
Major concerns:
Disposable signs in the right of way
Suspended signs that are out in the county and not over a downtown sidewalk
Maximum allowed size for real estate signs may be too restrictive
Maximum allowed size for no trespassing signs may be too restrictive

Neighborhood watch signs are attached to utility poles and street signs
Signs with blinking lights are not allowed

Mike Smolek requested that Joe share with the Board the types of sign complaints that come to the Area Plan Office.  Without research, Joe listed the following as typical sign complaints:
Off-premise business signs in a residential district
Real estate directional signs not taken down after a listing is sold or expired
Cluster of signs, i.e. Norway Road, West Shafer Drive
Too many real estate signs on a lot
Disposable signs on someone else’s lot
Sign reconstruction – when is compliance required
Too many disposable signs everywhere

The Board responded to Joe’s presentation with the following comments:
No signs in right of way at all
Do not regulate neighborhood watch signs
Do not regulate signs less than 2’ in height
Demand that each municipality regulate its own signs
The current proposal is too stringent

Mike Smolek suggested that the APC form a committee of its members to further simplify the proposed amendment.  Mike will head the committee.  They will attempt to complete their task prior to the first of the year.

There being no further business, Dave Scott motioned for adjournment; Greg Bossaer seconded; the vote was unanimous and the meeting adjourned at 8:45 pm.
