The White County Drainage Board convened at 10:30 A. M. in the Commissioners’ Room of the White County Building, Monticello, Indiana. Board members present were: Chairman Steve Burton, Drainage Board Member John Heimlich and Drainage Board Member David Diener. Also present were Attorney George W. Loy, Surveyor Bradley Ward and Drainage Assistant Mary Sterrett.

The March 19, 2012 White County Drainage Board was called to order by Chairman Steve Burton.


The first item on the agenda was to approve the minutes from the March 5, 2012 White County Drainage Board Meeting. Board Member John Heimlich so moved. Board Member David Diener seconded the motion. Motion carried.


Next on the agenda-Pulaski-White Rural Telephone Cooperative Drainage Review

(Viewing the drainage plan)

Surveyor Ward presented the Drainage Review for the Pulaski-White Rural Telephone Cooperative. Todd Frauhiger Engineer for the County was unable to attend due to a family emergency. Todd has reviewed the plans and visited the site.

  1. Surveyor Ward presented an e-mailed letter from Engineer Frauhiger to the

Board. (Copy of Engineer Frauhiger’s e-mail with the paper file copy of these minutes.)

  1. They will be adding some structure and removing some parking lot as per plans.

  2. Surveyor Ward’s concern is the North White Urban Drain. The structure is in the

seventy-five foot right of way. Tile was put in 1986 before the Drainage Ordinance went in to effect.

  1. This regulated drain was put in by the previous owner of the property, former Buffalo

Elementary School.

  1. The tile drains the school, cemetery and part of the town of Buffalo.

  2. No building will be closer than it is now to the tile but they will be driving near or on top of

the tile.

  1. Attorney Loy said to make it a condition of the drainage plan that no building will be built

closer to the tile than what is existing.

  1. Engineer Frauhiger’s letter states he recommends approval of the plan.

  2. Board will approve drainage plan subject to Pulaski-White Rural Telephone Cooperative

getting Consent to Encroach on the North White Urban Drain.

  1. The Cooperative should be made aware that if the tile needs to be dug up that the road will

also have to be dug up.

Board Member Diener made a motion to approve the Pulaski-White Rural Telephone Cooperative

Drainage Plan with the stipulation that the Pulaski-White Rural Telephone Cooperative go through the Consent to Encroach procedure on the North White Urban Tile. Board Member Heimlich seconded the motion. Motion carried.


Next on the agenda-Open Quotes on 2012 Ditch Spraying


Attorney Loy presented the five (5) quotes submitted for ditch spraying as follows:

  1. Townsend Tree Service Company: No quote submitted.

  2. Daltons: $48,828.00

  3. Shidelers Spray Inc.: $61,522.00

  4. Anderson Tree Company: $64,264.00

  5. Right of Way Management Co.: $64,320.41

The 2012 Spraying Projects will be awarded at the next Drainage Board Meeting giving Surveyor

Ward ample time to check the numbers on the submitted quotes.


Next on the agenda-Open Quotes on the Walter Chapman Drain #696 Maintenance Project


Attorney Loy presented the two (2) quotes submitted for the Walter Chapman Drain #696 Maintenance Project.

  1. County Line Tiling/Excavating: $7,500.00

  2. Dennis Sparks and Son: $7,900.00

Surveyor Ward presented to the Board.

  1. Surveyor Ward presented to the Board a brief explanation and location of the project.

  2. Shared ditch with Jasper County. A letter waiving their rights on this project is on file in the

Surveyor’s Office.

  1. Completion date will be one year from this date.

  2. Surveyor’s estimated cost of project: $8,000.00

Board Member Heimlich made a motion to accept the low bid of Seven Thousand, Five Hundred

Dollars ($7,500.00) from County Line Tiling/Excavating for the Maintenance Project on the Walter Chapman Drain #696. Board Member Diener seconded the motion. Motion carried.


Next on the agenda-J. L. Ackerman Branch #9 Drain #501 Issues-George & Evelyn Malchow


Surveyor Ward presented the Board the following:

  1. Mr. & Mrs. Malchow’s concerns over a project that was done in 2008.

  2. Project location was on the Moss farm Cass Township about two (2) miles east of Headlee.

  3. IDEM requested that a portion of the open ditch be closed in because of contaminates from

Moss’s hog operation possibly getting into the ditch. Irrigation was also being done on the Moss farm.

  1. Reconstruction was done by closing in part J. L. Ackerman Branch #9.

  2. Plans were reviewed by County appointed Engineer Todd Frauhiger. Plans were approved.

  3. A 36” tile with a waterway on top.

  4. No new tiles can be tied into what was closed in. New tiles need to drain into the open part

of the ditch.

  1. All expenses of the project were paid by Mr. Moss.

  2. Malchow’s have pictures that were taken in 2008 and just recently.

  3. The issue is trash getting onto the grate.

  4. Mr. Malchow has two hundred and forty (240) acres that drain to the ditch.

  5. The open tiles are on the property of Mr. Moss.

  6. Mr. Malchow said that he knew nothing about the project. He was not notified.

  7. Board Member Diener asked if the problem was strictly with the grate.

  8. Mr. Malchow said that it is because they aren’t keeping the grate cleaned.

  9. The agreement was that Mr. Moss would keep the grate free of debris.

  10. By holding the water back when there is a big rain it is caving his ditch banks in.

  11. Board Member Diener thought a simple salutation would be to notify Mr. Moss of the

requirement to keep the grate free of debris.

  1. Surveyor Ward said that tile is supposed to be self-cleaning.

  2. Chairman Burton commented that this ditch has a history prior to this reconstruction of the

banks sliding in. He explained to the Malchows the history that he was familiar with on this drain.

  1. The Board asked Surveyor Ward to verbally and with a written letter to Monty Moss

regarding keeping the grate clear of debris. (Copy of letter attached to the paper file copy of these minutes.)
