The White County Drainage Board convened at 10:30 A. M. in the Commissioners’ Room of the White County Building, Monticello, Indiana. Board members present were: Chairman Steve Burton, Drainage Board Member John Heimlich and Drainage Board Member David Diener. Also present were Attorney George W. Loy, Surveyor Bradley Ward and Drainage Assistant Mary Sterrett.

The April 2, 2012 White County Drainage Board was called to order by Chairman Steve Burton.

 

The first item on the agenda was to approve the minutes from the March 19, 2012 White County Drainage Board Meeting. Board Member John Heimlich so moved. Board Member David Diener seconded the motion. Motion carried.

 

Next on the agenda-Ken Rayman Issue with Water Way in Prairie Township

Surveyor Ward presented to the White County Drainage Board Ken Rayman with his issue with the T. Nichols Water Way that is on his land lady’s property.

l. Property owner-Sandra Orr-Tenant-Ken Rayman.

2. Cindy Muffett-District Conservationist-representative of NCRS spoke on behalf of the CRP and the landowner.

3. The water way is a County Regulated Water Way with a twelve inch regulated tile under the water way. Which are on periodic maintenance with the W. F, Myers Drain since 1996.

4. The water way has been in the Conservation Reserve Program (CRP) for ten (10) years, 2000. Which is being reconstructed as a cost sharing project between NCRS and the landowner in order to put the water way back into the Conservation Reserve Program.

5. The cost of the reconstruction of the new water way is approximately sixty thousand dollars ($60,000.000).

6. The design of the new water way needs for the twelve inch County Tile to be moved or replaced in order to meet the CRP specification requirements. Which is the tile must have a twelve (12) inch land cover or a smooth core tile.

7. NCRS does not fund tile replacement or moving a tile.

8. Ross Hardebeck is doing the reconstruction on the water way. He quoted Ken Rayman a cost for moving the tile and the tile cost of four thousand dollars ($4,000.00).

8. In order for the County to move the tile it would have to be a Reconstruction with a Hearing. The entire water shed of the W. F. Myers Drain would be paying for the project.

9. Chairman Burton questioned how the water way was regulated by the County and be in the CRP. Cindy Muffett explained that it was not known by the landowner or NRCS that is was a County Regulated Water Way and Tile.

10. The landowner is paid by the CRP for the water way which is taken out of crop production plus this water way is regulated by the County and on a maintenance program.

11. With much discussion the solution to the problem was the County will pay for smooth core tile to replace the old tile for three hundred and eighty (380) feet only. The landowner will be responsible for the cost of putting it in. The tile will not be relocated just replaced and the W. F. Myers Drain Maintenance Fund will take care of the expense of buying the smooth core tile.

 

Board Member Heimlich made a motion to replace not relocate the old tile with smooth core tile with the County only paying the cost of the tile for three hundred and eighty (380) feet and the landowner paying for insulation of the tile. Board Member Diener seconded the motion. The motion carried.

 

Next on the agenda-Award 2012 Spraying Project

 

Surveyor Ward presented to the White County Drainage Broad the following:

  1. Surveyor Ward has checked the quotes received for 2012 Spraying.

  2. Daltons were the low quote and everything appears to be what was asked of them to quote

and in order.

  1. Daltons stated they would have ninety percent (90%) kill or they would return to re-spray.

 

Board Member Diener made a motion to accept the Daltons’ low bid of Forty-Eight Thousand, Eight Hundred and Twenty-Eight Dollars ($48,828.00) for the 2012 Spraying of County Regulated Ditches. Board Member Heimlich seconded the motion. Motion carried. Daltons awarded the spray project for 2012.

Next on the agenda-Girtz Industries for Preliminary Approval to Start Work on Parking Lot Project

 

Surveyor Ward presented to the White County Drainage Board that Girtz Industries just wanted to move dirt on their parking lot project. Their drainage plan is up for Drainage Review on April 16, 2012. Surveyor Ward saw no reason for them not to start the project. The Drainage Board gave permission for them to start as long as they understand that if there is a problem with their drainage plan they would need to meet the requirements of the plan. Jeremy Scheitlin-Titan representative for Girtz Industries said he understood.

 

Next on the agenda Rudy Owens-Consent to Encroach the William Spencer Branch of the James Carter Drain #621

 

Surveyor Ward showed the location of the tile that Mr. Owens needs to encroach.

1. Mr. Owens not present.

2. Mr. Owens is putting an addition on to his current building.

3. The addition to the building is planned to be forty-eight (48) feet from his property line. The tile in question is on that property line.

3. Board Member Heimlich visited the location and states he sees no problem with granting Mr. Owens Consent to Encroach on the William Spencer Tile Branch of the James Carter Drain.

4. Attorney Loy needs Mr. Owen’s deed and plan for his addition in order to prepare the paper work for the Encroachment.

5. Surveyor Ward said he would obtain those documents from Area Plan.

 

Board Member Heimlich made a motion to allow Mr. Owens Consent to Encroach on the William Spencer Tile Branch of the James Carter Drain. #621. Board Member Diener seconded the motion. Motion carried.

 

With nothing further for the White County Drainage Board Chairman Burton adjourned the April 2, 2012 White County Drainage Board Meeting.
