BZA MEETING MINUTES THURSDAY AUGUST 30, 2012

The White County Area Board of Zoning Appeals met in Special Session on Thursday, August 30, 2012 at 7:00 p.m. in the Commissioners’ Meeting Room, Second Floor, White County Building, Monticello, Indiana.

Members attending were: Carl Hites, Dennis Sterrett, Richard Holmes, Dave Rosenbarger. Absent: None. Also attending were Director Joseph Rogers and Secretary Gayle Rogers

Visitors attending were: Christina Heath of the Herald Journal

The meeting was called to order by Chairman Hites. The Special Session was

called for the sole purpose of adopting new BZA By-Laws. Director Rogers explained that much of the verbiage is straight out of Indiana State Statute and can not be varied. After discussion, the following modifications were agreed upon:

III. Election of Officers – add term limit of two consecutive years followed by at least one year off

VI. Board Meetings – If a special meeting is called for a variance or special exception use, add the length of time notification is required. Delete that the Secretary may call a special meeting.

VII. Voting – Director to check with Attorney as to whether a board member with a conflict of interest can be a citizen participant and add the appropriate verbiage.

VIII. Filing Procedures – Procedure is given for the filing of two separate special exception uses by one applicant. Change “two” to “two or more”.

IX. Procedures for Public Hearings – remove the 10 minute speaker limit and add that the Chairman has the right to deny repetitive testimony. Remove the “failure to seat a full board” from the petitioner’s two allowed continuances and add it to the board created continuances. Staff reports, written briefings, etc. should be available to anyone upon request, not just the applicant and interested persons. Following a hearing, any brief, memorandum of law or findings of fact filed with the board by any person having appeared at the hearing will be available to the public upon request, but will not be mailed to anyone in particular.

As there was no further business, Denny Sterrett motioned to adjourn, seconded by Dave Rosenbarger followed by a unanimous vote; President Hites adjourned the meeting at 7:35 pm.
